74.   Driving without due care and without consideration

  1.  

    (1)   A person shall not drive a motor vehicle on a road —

    1.  

      (a)     without due care and attention; or

    1.  

      (b)     without consideration for other users of the road.

    (2)   A person who contravenes subsection (1) commits an offence and is liable on summary conviction to a fine not exceeding $2,000 or to imprisonment for a term not exceeding 6 months or to both, and in addition to the sanction specified under section 106. (Substituted by Act 10 of 2006)

    (3)   For purposes of this section, without due care and attention includes driving whilst using an electronic device in such a manner as to impair the driver's judgement in the safe use of the road. (Amended by Act 10 of 2006)
