188.   Cycling when under influence of drink or drug

  1.  

    (1)   A person who, when riding a motor cycle, not being a motor vehicle, on a road or other public place is unfit to ride through drink or drug commits an offence and is liable on summary conviction to fine not exceeding $500 or to imprisonment for a term not exceeding one month or to both. (Substituted by Act 10 of 2006)

    (2)   A police officer in uniform or with proper identification may arrest without a warrant a person committing an offence under this section.

    (3)   In this section “unfit to ride through drink or drug” means, as regards a person riding a motor cycle, under the influence of drink or drug to such extent as to be incapable of having proper control of the motor cycle.
