(1) If the Commissioner determines that the detention was in accordance with this Act, the motor vehicle or trailer shall remain detained in storage in accordance with this Act.
(2) If the Commissioner determines that the detention was not in accordance with this Act, the Commissioner shall order the release of the motor vehicle or trailer.
