9.   Appeal from adjudication of unsoundness of mind

  1.  

    (1)   In case of any order under this Act by a magistrate adjudging any alleged person of unsound mind to be a person of unsound mind and a proper subject of confinement, and in case of a refusal so to adjudge, an appeal to the High Court shall lie, subject to the same conditions and with the same consequences as if the alleged person of unsound mind had been convicted of an offence punishable on summary conviction in a case in which an appeal would lie.

    (2)   Where upon any appeal under this section the alleged person of unsound mind demands before the judge that the issue whether he or she is or is not of unsound mind and a proper subject of confinement be tried by a jury, such issue shall be tried accordingly.

    (3)   The judge may in any case in which he or she sees fit direct that such issue be tried as aforesaid.

    (4)   The judge may make general orders for regulating the procedure in cases of trial by jury under this section.
