23.   Appeal by licensee

Where under this Act a magistrate orders the removal of a person of unsound mind from a licensed house on the ground of ill-treatment or neglect, or orders a person of unsound mind confined in a licensed house to be released, the licensee may appeal against such order subject to the same conditions and with the same consequences as if he or she had been convicted of an offence punishable on summary conviction in a case in which an appeal would lie.
