Where it appears to a magistrate that the persons at whose expense a person of unsound mind is maintained in a licensed house are desirous that the person should be removed from such licensed house and that provision has been made for his or her care and custody in a mental hospital or in a suitable licensed house, the magistrate may make an order for the removal of the person and the discharge of the licensee accordingly.
