Where upon the information upon oath of any person it appears to a magistrate that a person of unsound mind confined in a licensed house is ill-treated or neglected, the magistrate may order the person to be removed to a mental hospital or to a suitable licensed house and thereupon the licensee of the first mentioned licensed house shall be discharged.
