40.   Vesting of property belonging to a person of unsound mind in Administrator General

Where the High Court or judge orders under this Act the property of any person of unsound mind or the income thereof to be applied in or towards his or her maintenance or support, such Court or judge may make an order—

  1.  

    (a)     vesting the property of such person in the Administrator General;

    (b)     empowering the Administrator General to sell the property of such person according to the formalities required by law with regard to the sale of vacant property; and the proceeds of such sale shall be applied towards the past and future maintenance of such person in such manner as the Court or judge directs. However, after the discharge of such person from a mental hospital he or she shall be entitled to the residue of all such proceeds of sale and that after the death of such person his or her heirs, successors and assigns shall be entitled thereto.
