35.   Absence on trial of inmate of unsound mind

  1.  

    (1)   The Governor General may allow any person of unsound mind confined in a mental hospital for inmates to be absent from such hospital on trial for any period which he or she thinks fit, and may at any time grant an extension of such period.

    (2)   If such person does not return at or before the expiration of such period or extended period of observation, he or she may be retaken as if he or she had escaped on the last day of such period or extended period.

    (3)   A person of unsound mind shall not be allowed to be absent on trial under this section unless a person enters into an agreement approved by the Governor General to take charge of him or her.
