94.   Conditions of demanding and accepting payment

  1.  

    (1)   A supplier shall not demand or accept payment or other consideration for the supply of goods or service, if at the time of the demand or acceptance, that supplier —

    1.  

      (a)     does not intend to supply the goods or service;

    1.  

      (b)     intends to supply the goods or service which is materially different from the goods or service in respect of which the payment or other consideration is demanded or accepted; or

    1.  

      (c)     does not have reasonable grounds to believe that the goods or service will be supplied within the period specified, or if no period is specified, within a reasonable time.

    (2)   A supplier who contravenes this section commits an offence and is liable on summary conviction to a fine not exceeding $3,000 and in default of payment of the fine, to imprisonment for a term not exceeding one year or to both.
