70.   Unauthorised hire

  1.  

    (1)   A person shall not hire out a motor vehicle or trailer unless the person holds a valid Motor Vehicle Rental Licence. (Substituted by Act 10 of 2006)

    (2)   A person who contravenes subsection (1) commits an offence and is liable on summary conviction to a fine not exceeding $1,000 or to imprisonment for a term not exceeding 3 months or to both. (Substituted by Act 10 of 2006)

    (3)   If an offence is committed under this section by an employee in the course of business of the employer, the employer is guilty of the like offence unless the employer establishes that the offence was committed without his or her knowledge or consent and that he or she exercised all due diligence to prevent its commission.

    (4)   If an offence is committed under this section, the registered owner of the motor vehicle is guilty of the like offence unless he or she establishes that the offence was committed without his or her knowledge or consent and that he or she exercised all due diligence to prevent its commission.
