CATEGORIES OF LICENCES AND PERMITS

26.   Motor Vehicle or trailer licence

  1.  

    (1)   For purposes of this section, the Minister shall, by order in the Gazette, prescribe —

    1.  

      (a)     categories of vehicles or trailers for which a motor vehicle or trailer licence is required;

    1.  

      (b)     the period of validity of the motor vehicle or trailer licence in respect of each category;

    1.  

      (c)     the fees payable in respect of each category of licence.

  1.  

    (2)   Subject to any order made under subsection (1), a person shall use or permit the use of a motor vehicle or trailer on a road for which a motor vehicle or trailer licence is required under this section.

  1.  

    (3)   On application in the prescribed manner and on payment of the prescribed fee, the Licensing Authority may issue a motor vehicle or trailer licence to the owner of a motor vehicle or trailer of a category prescribed under this section, if the motor vehicle or trailer complies with the prescribed requirements.

    (4)   A motor vehicle or trailer licence may be issued subject to any conditions that the Licensing Authority considers necessary.

  1.  

    (5)   A motor vehicle or trailer licence is renewable annually, on payment of the prescribed fee, on a date coinciding with the date on which it was first issued and the provisions of this section shall apply with the necessary modifications in relation to an application for renewal.     (6)   Notwithstanding this section, on application in the prescribed manner the Licensing Authority may exempt an owner from the payment of the fees under this section from the date that the licence expires if it is satisfied that —

    1.  

      (a)     the motor vehicle or trailer has been involved in an accident and has been off the road for more than one year, pending repairs;

    1.  

      (b)     the motor vehicle or trailer requires specific parts that the owner was unable to afford at the time or the parts could not be immediately obtained;

    1.  

      (c)     the owner travelled overseas leaving the motor vehicle or trailer off the road in storage or at the private dwelling of the owner for more than one year.

    (7)   An application under subsection (6) must contain —

    1.  

      (a)     a statutory declaration or an affidavit;

    1.  

      (b)     a letter from an insurance company certifying that the motor vehicle or trailer has not been insured for the period for which the exemption is requested;

    1.  

      (c)     a letter from a person designated as an inspector under section 16 indicating that the motor vehicle or trailer is in need of repairs.
