(1) In this section, change of ownership does not include transfer under an instrument of security.
(2) Before the expiration of 7 days after a change of ownership, an application shall be made for amendment of the Register.
(3) The application shall be in the prescribed form and accompanied by the prescribed fee, documents establishing change in title and, if the transfer is by voluntary act, the Certificate of Registration and proof of payment of insurance shall also be annexed.
(4) The transferee and the transferor commit an offence if subsection (2) is not complied with and are each liable on summary conviction to a fine of $1,000 and a further fine of $50 for every day that the offence continues or to imprisonment for one year. (Amended by Act 10 of 2006)
(5) The provisions of subsection (3) shall not apply in respect of motor vehicles or trailers registered before 1990 in respect of the Certificate of Registration.
