(1) In a review by the Review Commissioner of the facts of a violation under section 17, the Review Commissioner shall establish, on the balance of probabilities, that the person named in the notice of violation committed the violation identified in the notice.
(2) In a review of a detention by the Review Commissioner under section 162, the Review Commissioner shall establish, on the balance of probabilities that the detention was in accordance with this Act.
