52.   Restriction on operations

  1.  

    (1)   A person shall not operate an aircraft—

    1.  

      (a)     registered in Saint Lucia;

    1.  

      (b)     in or over Saint Lucia;

    1.  

      (c)     outside of Saint Lucia, in the case of a person who is the holder of a valid air operator certificate issued pursuant to these Regulations;

  1.  

    unless the person complies with the requirements specified in subregulation (2).

  1.  

    (2)   The requirements referred to in subregulation (1) are that—

    1.  

      (a)     the aircraft is in compliance with the aircraft requirements specified in these Regulations and Part 8 of the Schedule;

    1.  

      (b)     the flight crew comply with the flight crew requirements, duties and responsibilities specified in these Regulations including Part 8 of the Schedule;

    1.  

      (c)     the flight complies with the requirements specified in these Regulations including Part 8 of the Schedule for all passenger carrying operations;

    1.  

      (d)     the flight plans, flight planning and other preflight preparations comply with the requirements specified in these Regulations and Part 8 of the Schedule;

    1.  

      (e)     the flight is conducted in compliance with the flight rules specified in these Regulations including Part 8 of the Schedule unless, in the case of an aircraft being flown outside of Saint Lucia, such compliance would result in non-compliance with a law or Regulation of the State over which it being flown.

    1.  

      (f)     the flight is conducted in compliance with the requirements specified in these Regulations for operations in controlled flight unless, in the case of an aircraft being flown outside of Saint Lucia, such compliance would result in non-compliance with a law or Regulation of the State over which the aircraft is being flown.

  1.  

    (2)   A person shall not recklessly or negligently cause or permit an aircraft to endanger any person or property.

  1.  

    (3)   A person in an aircraft registered in Saint Lucia or elsewhere, shall obey all lawful commands which the pilot in command of that aircraft may give for the purpose of securing the safety of the aircraft and of persons or property carried therein, or the safety, efficiency or regularity of air navigation.

  1.  

    (4)   A person shall not while in an aircraft—

    1.  

      (a)     use any threatening, abusive or insulting words towards a member of the crew of the aircraft;

    1.  

      (b)     behave in a threatening, abusive, insulting or disorderly manner towards a member or the crew of the aircraft; or

    1.  

      (c)     intentionally interfere with the performance of the crew of an aircraft of his duties.
