52.   Regulations for miscellaneous matters

(1)   The Minister may make Regulations—

  1.  

    (a)     for the control of aircraft while carrying passengers or goods for hire or reward within Saint Lucia by any person;

  1.  

    (b)     as to the circumstances in which a licence or permit may be granted, refused, suspended or revoked and, as to any matter to which the Air Transport Licensing Board is to have regard in deciding whether to grant or refuse a licence or permit;

  1.  

    (c)     as to the conditions which may be attached, to a licence or permit, including conditions as to fares, freight or other charges to be charged by the holder of the licence or permit, and for securing compliance with any conditions so attached;

  1.  

    (d)     prescribing the information to be furnished to the Air Transport Licensing Board by an applicant for a licence or a permit or by the holder of a licence or permit and the time, form, and manner in which such information is to be furnished;

  1.  

    (e)     establishing different classes of aircraft and different classes of licences or permits;

  1.  

    (f)     as to appeals from the decision of the Air Transport Licensing Board by persons interested in the grant, refusal, revocation or suspension of a licence or permit;

  1.  

    (g)     as to the ticketing and identification of licence or permit holder offering a service in conjunction with a code share agreement or alliance with other air operators;

  1.  

    (h)     as to the information to be furnished to the Air Transport Licensing Board by an applicant for, a licence or permit;

  1.  

    (i)     as to the terms of appointment, the tenure and remuneration of the Air Transport Licensing Board members;

  1.  

    (j)     for the protection or preservation of any evidence that has been seized without a warrant under section 46(2)(a) or aircraft that has been detained under section 46(2)(b); (Amended by Act 25 of 2023)

    (k)     the return of evidence or aircraft to the owner thereof or the person from whom the evidence was seized or who had custody of the aircraft when it was detained; (Amended by Act 25 of 2023)

    (l)     for matters relating to the minimum amount of liability insurance required of owners and operators of aircraft; (Inserted by Act 25 of 2023)

    (m)     for matters relating to national emergencies; (Inserted by Act 25 of 2023)

    (n)     for matters he or she is responsible for with respect to fees payable, the amount of the fees and the person by whom the fees are to be paid and authorizing the refund of fees in prescribed circumstances; (Inserted by Act 25 of 2023)

    (o)     for the issuance and administration of air service licences and permits that may be subject to conditions, limitations and restrictions, to national and foreign operators where the national and foreign operators use aircraft for commercial purposes. (Inserted by Act 25 of 2023)

    (2)   The Minister may make Regulations exempting, on such terms and conditions as may be specified in the Regulations, a person, an aircraft of such description, a flight, an aerodrome, a facility or a service from the application of Regulations made under this section. (Inserted by Act 25 of 2023)

    (3)   An exemption made under subsection (2) may be granted to a person, aircraft of such description, flight, aerodrome, facility or service whether or not a civil aviation document has been issued under this Act. (Inserted by Act 25 of 2023)
