(1) Every person who commits an offence against this Act or against any by-law made under this Act shall, on being convicted, be liable to a penalty not exceeding $48, and in default of payment to imprisonment with or without hard labour, for any term not exceeding 2 months.
(2) Every proceeding under this Act shall be in the name and at the instance of the Clerk in whose urban, village or rural district the offence was committed, before the Magistrate of the Judicial District in which such district is situated.
