Collection Fee

Upon payment after August of each rate or tax due as a judgment debt for being in arrear, a collection fee shall be payable according to the following scale:

    Any other expenses of sale including expenses incurred with a view to sale such as guardianship or safekeeping, bell or otherwise which the Sheriff (whose denomination shall be final) determines to have been absolutely necessary in the circumstances.

TOWNS AND VILLAGES (MANAGEMENT)
1.   General rules
DEFINITIONS
  1.  

    1.   In these Rules—

building” includes a house of whatever description whether used as a dwelling or for any purpose whatever, and includes galleries, balconies, verandahs, abatvants, perrons and steps;

public place” includes any street, square, market, beach, wharf, jetty or open space of land or other place to which the public have a right of access or use;

town” includes village.

ERECTION AND REPAIR OF BUILDINGS
  1.  

    2.   No person shall erect any building without the written permission of the Town Warden on a written application.

  1.  

    3.   The Town Warden before granting such permission shall satisfy himself or herself that the same will not encroach on any public place in or near which it is to be erected and that the lot upon which it is to be erected is not on a lower level than the sidewalk or street, and that provision is made for the proper drainage of such lot.

  1.  

    4.   Every building of one storey whether of wood or stone shall have a height of 9ft. at least from the sill to the plate and if constructed of wood shall be raised on all sides one foot at least from the ground on masonry with due ventilation under the floor.

  1.  

    5.   Every building of 2 or more stories shall have a height of 9ft. at least between the floors of each storey commencing from the basement floor upwards.

  1.  

    6.   No existing building shall be extended either in height or in a lateral direction except in manner herein before provided.

  1.  

    7.   The roof of every building in which fire is used shall be covered with tiles, slates, or metal and the floor of every such building shall be paved or concreted.

  1.  

    8.   Every stable shall be floored, concreted, or paved, and have proper drains leading to a cesspool of sufficient size, and every such cesspool shall be properly made with cement, and shall be emptied when necessary and at least twice a day and disinfected.

  1.  

    9.   No person shall erect any building, perron, step, balcony, verandah, gallery or abatvant in or over any street or public place without the permission of the Town Warden.

  1.  

    10.   Every balcony, gallery or verandah over a public way shall be open and so constructed as to allow of free and easy passage along the public place in which the same may be erected, and if erected over a sidewalk shall be of the same width as the sidewalk and if erected otherwise shall be of such width as the Town Warden may direct.

  1.  

    11.   Every abatvant shall be so constructed as to allow of free, easy and unobstructed passage along the public place in which the same may be erected, and if erected over a sidewalk shall be of the width of the sidewalk and if otherwise of such width as the Town Warden may direct, and shall be not less than 8ft. high at its lowest part.

  1.  

    12.   No existing balcony, gallery, verandah or abatvant shall be repaired unless such repairs shall include where necessary the extension to the required width and with respect to abatvants to the required height as laid down in rules 10 and 11.

  1.  

    13.   No person shall remove any building without the written permission of the Town Warden; and any such removal shall be subject to his or her direction in every respect.

  1.  

    14.   The provisions of Rules 2, 3, 4 and 5 shall apply to buildings removed in pieces from one place for re-erection in another; but nothing in Rules 4 and 5 shall prevent the removal in pieces and the re-erection of a building which was in existence prior to the date of the passing of these Rules.

  1.  

    15.   Where the water from the eaves of any building falling on any public place is causing or likely to cause any damage thereto the Town Warden may require the proprietor of such building to place gutters along the eaves, and down spoutings to carry off the water from such gutters into the drain of the street.

  1.  

    16.   Where any building erected after the coming into force of these Rules encroaches upon any public place the owner shall be bound to remove the encroachment on being called upon by the Town Warden in writing to do so, and if he or she fails to do so, he or she commits an offence for each and every month of his or her non-compliance.

OFFENCES RELATING TO PREMISES AND PUBLIC PLACES

  1.  

    17.   The Town Warden shall have power to visit and inspect all houses, yards and lots within the Town and may order and direct any rubbish, filth, stagnant or foul water there found, to be removed, and may order any bush or underwood, found in any yard or lot to be removed, which order in each and every case the occupier or the owner, if the premises are unoccupied, shall be bound immediately to obey.

  1.  

    18.   The Town Warden shall have power to order the laying down of new drains or the re-construction of existing drains whenever he or she is of opinion that the drainage of any premises is insufficient or defective.

  1.  

    19.   The owner of any premises within any Town which abuts upon or is bounded by any ravine, or other water course, shall be responsible for the complete cleanliness of such ravine or water course within the limits of his or her premises and for the immediate removal thereon of all grass, weeds, filth or rubbish.

  1.  

    20.   No person shall allow any filth or rubbish to remain, or accumulate upon his or her premises or permit any stagnant or offensive water, or any growing grass or weeds to remain thereon or allow any filth, stagnant or offensive water to drain into any public place or into the premises of any other person.

  1.  

    21.   

  1.  

    (1)   The occupier of any premises shall collect every morning in a box or other receptacle all refuse, sweepings, manure, straw broken glass and crockery, and other rubbish in such premises, and remove the same to such place, as may, subject to the direction and approval of the Governor General, be from time to time appointed for the purpose by the Town Warden, or keep the same ready for removal by the cart to the place so appointed, if any, employed for the purpose, as the Town Warden shall direct.

  1.  

    Provided that all such broken glass and crockery shall for such removal be collected separately by the occupier.

  1.  

    (2)   The place appointed shall not be a neighbouring estate or plantation, unless the Governor General is satisfied that there is no other available place, in which case the place so appointed shall be such part of an estate or plantation as the Governor General may direct or approve.

  1.  

    (3)   No such box or receptacle should be placed or allowed to remain in any public place, and in the case of removal by a cart, it shall be brought out and delivered to the cartman so soon as he or she sound his or her bell for the purpose.

  1.  

    (4)   An occupier may, however, remove or allow to be removed from his or her premises for manurial purposes any stable, manure or litter, but such removal must take place daily.

  1.  

    (5)   If in the process of removal through any Town or Village of any refuse, sweepings, manure, litter, straw, broken glass, crockery, or other rubbish, any person shall drop, spill or deposit, or cause or allow to be dropped, spilled or deposited, the same or any part thereof, he or she shall immediately remove it from the place whereon it may have been dropped, spilled or deposited, and shall immediately thereafter thoroughly sweep or otherwise thoroughly clean such place.

  1.  

    22.   No person shall throw any glass, crockery, fruit-skins, filth, foul water or rubbish, or place any stone or other matter or thing of whatsoever kind, in any public place.

  1.  

    23.   No person shall allow any article belonging to him or her or being in his or her charge to remain on any footway or in any public place for a longer time than may be necessary for moving such articles out of or into his or her premises.

  1.  

    24.   No person shall by drumming, quarrelling or making a noise cause annoyance to any inhabitant of any Town.

  1.  

    25.   No person shall hang out or expose or allow to be hung out or exposed in or immediately facing any public place any linen, clothing, blankets, or bedding.

  1.  

    26.   No person shall deposit human excreta in the aforesaid refuse or other rubbish collected for removal, or convey any human excreta along any public place except in a properly secured and covered pail or other receptacle, and except between the hours of 8p.m. and 6a.m.

  1.  

    Provided that in the case of the Towns of Soufriere and Vieux-Fort and the Villages of Anse-la-Raye, Canaries, Dennery and Laborie the said hours shall be 9p.m. to 6a.m.

  1.  

    27.   No person shall deposit human excreta in any other place than that appointed by the Town Warden, and where in any Town defection jetties are provided all human excreta shall be thrown from such jetties into the sea unless otherwise ordered by the Town Warden.

  1.  

    28.   No person shall convey or carry on or along any sidewalk, any receptacle containing water, or human excreta or any offensive matter or thing, or convey or carry any bulky package, or any tray, bundle, box, bag or other package containing vegetables, fruit, cakes, or other thing whatsoever, except for the purpose of loading or unloading or of crossing into or out of any premises.

  1.  

    29.   No person shall stand upon any side walk to the inconvenience or obstruction of any passenger thereon.

  1.  

    30.   No person shall sit on the back or hand rails of any seat or bench in any public place.

  1.  

    31.   No person shall lead, ride or drive any animal over any market or square.

  1.  

    32.   No person shall remove any barrier placed in any public place by the Town Warden or any person having authority to do so, or pass any animal or cart along or across any street which has been closed temporarily for repairs.

  1.  

    33.   No person shall wash any animal or thing or bathe or cause to be bathed any child in any public place.

  1.  

    34.   No person shall sell or dispose of, or expose for sale or disposal, or cause to be sold or disposed of or exposed for sale or disposal, any salted meat or fish in any public place.

  1.  

    35.   Where any tree or part of a tree overhangs any premises the owner of such premises, by notice in writing to the owner of the premises on which such tree is, may require the latter to cut down such tree or part thereof as overhangs, and if such notice is not complied with within 5 days the person aggrieved may lodge a complaint in writing before the Magistrate, who shall investigate the said complaint and make such order thereon as he or she may think fit. Every person named in such order who fails to obey the same within the time named therein shall for every week of his or her disobedience commits an offence.

  1.  

    36.   No person shall sell, barter, or expose for sale or barter, or cause to be sold, bartered, or exposed for sale or barter, any adulterated milk or milk of a less specific gravity than 1021.

MARKETS

  1.  

    37.   The markets shall be under the control and direction of the Town Warden and shall be open from sunrise to sunset on every day except Sundays, Christmas Day, Good Friday, Corpus Christi Day, or any day set apart for Divine Service, and no person shall offer or expose for sale any article at any time between sunset and sunrise without the permission of the Town Warden: Provided that the sale of bread, cakes, milk, fresh fish, butcher's meat and fresh fruit shall be regulated as provided in the Criminal Code or any Act amending or repealing the same.

  1.  

    38.   The slaughter houses and meat stalls shall be under the supervision of the Town Warden who may issue such orders as he or she may consider necessary for their complete cleanliness.

  1.  

    39.   No person shall slaughter any animal, or sell, or cry out, or expose for sale, any meat or slaughtered turtle in any other place than that appointed by the Town Warden: Provided that any person may with the written permission of the Town Warden, slaughter for his or her own use and not for sale in his or her premises any sheep, goat, pig, or turtle or other animal other than kine.

  1.  

    40.   Any person who inflates or is concerned in the inflating of any meat with air from human lungs, or sells, barters, gives away or exposes for sale, any meat so inflated, commits an offence.

HARBOURS

  1.  

    41.   The Town Warden shall have entire control of the Harbour or Bay of his or her respective Town or Village and of the public jetties that may be erected therein, and may appoint the place where any steamer, vessel, or boat shall be moored or anchored and may direct the Master of any steamer, vessel or boat to change the berth of such steamer, vessel or boat to some other place.

  1.  

    42.   No warps or fasts shall be tied across any street or to any tree in the vicinity of the beach without the permission of the Town Warden.

  1.  

    43.   Any person who shall tie any warp or fast to any lamp post commits an offence.

  1.  

    44.   No person shall remove any sand, stones or gravel from the beach in front of any Town for any purpose whatever.

  1.  

    45.   No person shall lay up any flat or boat in any other place than that set apart for the purpose without permission of the Town Warden.

  1.  

    46.   No person shall loiter or remain upon any public jetty while any steamer, vessel or boat is alongside, and any person so found shall be bound to more off when required by the Town Warden or any Police Officer.

  1.  

    47.

  1.  

    (1)   The owner of every dog of or above the age of 3 months kept in the Towns of Soufriere and Vieux Fort, or in the Villages of Choiseul, Laborie, Micoud, Dennery, Gros Islet, Anse-la-Raye, and Canaries, shall be bound to take out on or before the 31 January in every year, at the office of the Sub-Collector of Taxes in his or her District, a licence to keep such dog, and shall for every such licence pay the sum of $1.20, or such other sum as Cabinet may from time to time fix by notice in the Gazette, and every licence taken out as aforesaid shall commence on the day on which the same shall be granted and shall terminate on the 31 December following.

  1.  

    (2)   Every such licence shall be issued in respect of only one Town or Village and it shall not authorize the person taking it out to keep a dog in any Town or Village other than the Town or Village in respect of which it was issued.

  1.  

    48.   Every person who becomes the owner of an unlicensed dog at any time shall take out a licence as aforesaid within 7 days after he or she becomes such owner, and on or before the 31 January in every year thereafter so long as he or she is the owner of such dog.

  1.  

    49.   The proof of the age of any dog shall be upon its owner.

  1.  

    50.   Every person in whose custody, charge, or possession, or in whose house or premises any dog shall be seen or found, shall be deemed to be the owner of such dog, unless the contrary be proved by such person.

  1.  

    51.   If any person shall keep a dog within the precincts of any of the Towns or Villages aforesaid without having a licence authorizing him or her so to do, such person shall forfeit and pay a fine not exceeding $9.60, or in default of payment be liable to imprisonment for any term not exceeding 14 days.

  1.  

    52.   Any person who shall have taken out a licence under these Rules shall on demand of the Town Warden or a Police Constable produce and deliver such licence to him or her for examination, and such person refusing or neglecting so to do within a reasonable time after such demand shall, on conviction, be liable to a fine of any sum not exceeding $9.60, or in default of payment to be imprisoned for any term not exceeding 14 days.

  1.  

    53.   The Treasurer shall immediately after the expiration of each quarter publish in the Gazette a list of the licences granted during every such quarter in which shall be stated the number and date of each such licence and the name of the person taking out the same, and copies of such list shall be posted up in the Office of the Town Warden and at the Police Station in the Town or Village.

GENERAL

  1.  

    54.   The Town Warden may appoint places within the Town for securing animals ridden or brought into Town and no animal when secured in such places shall be liable to seizure.

  1.  

    55.   The Town Warden shall inspect all Cemeteries in any Town and may at any time for such purpose enter any Cemetery and require that the graves be dug to a depth of 6ft. for the burial of persons above the age of 12 years, and of 5 ft. for the burial of persons under the age of 12 years.

  1.  

    56.   

  1.  

    (1)   The Town Warden may cause a number to be painted on or affixed to any house or building for the purpose of identifying the same, and may cause such names as the Governor General may approve to be affixed or exhibited on any house or building for the purpose of identifying the various streets.

  1.  

    (2)   No person shall damage, remove, deface or interfere with any such number or name.

  1.  

    57.   No person shall burn any limestone or charcoal within the limits of any Town or within half a mile to windward of any Town.

  1.  

    58.   All public places shall be under the entire control of the Town Warden and no person shall make use of any public place for any purpose whatever whereby the right of the public to use such place shall be interpreted with or their passage interrupted, without the permission of the Town Warden: Provided that this rule shall not apply in respect of religious processions or funerals.

PENALTIES

  1.  

    59.   Every person who shall commit a breach of any of the rules hereinbefore defined, or who shall obstruct, resist, molest or interfere with the Town Warden or any Police Officer or Town Constable in the execution of his or her duty or who shall refuse or neglect to obey any instructions issued by the Town Warden or any Police Officer with respect to any rule commits an offence and being convicted thereof is liable in cases where no other punishment is hereinbefore prescribed to a penalty not exceeding $24 and in default of payment to imprisonment for any term not exceeding one month.

  1.  

    60.   The Court may award a portion of any penalty not exceeding $1.20 to any person other than the Town Warden through whose instrumentality a conviction may have been secured.

PROCEDURE

  1.  

    61.   Every proceeding instituted under these rules shall be in the name and at the instance of the Town Warden before the District Court and the procedure shall be the same as the procedure for the time being in force in respect of offences punishable on summary conviction.

2.   Soufriere Market
RULES FOR THE CONTROL AND MANAGEMENT OF THE SOUFRIERE MARKET

The appointment of the Market, its Control and Management

  1.  

    1.   The “Soufriere Market” shall mean the market house erected for the purpose and shall include the slaughterhouse, fish and other stalls, and all buildings, pavements, steps, approaches, tanks, water pipers, baths, latrines, walls, fences, hedges and all land which may be enclosed, set aside or appropriated for the use or purpose of the market.

  1.  

    2.   The market shall be under the general supervision and control of the Town Warden, who shall appoint a Market Clerk and such assistants and servants as may from time to time be necessary.

  1.  

    3.   The salaries of the Market Clerk, assistants and servants shall be fixed by the Town Warden with the approval of Cabinet.

  1.  

    4.   The Warden may dismiss or fine the Market Clerk and any assistant and servant for any misconduct or neglect of duty, and any fine imposed shall be deducted from any salary due, and may be made payable in instalments.

  1.  

    5.   The Market Clerk shall be subject to the direction and control of the Town Warden and shall be responsible for the management of the market, the collection of all market dues, and for all property delivered to him or her for the use of the market and shall keep an inventory of the same.

  1.  

    6.   He or she shall attend at the market from day to day during the hours the same shall be open, and shall not leave the market or delegate his or her duties to any person without the sanction of the Town Warden and any person acting for the Market Clerk shall have and exercise all his or her powers.

  1.  

    7.   He or she shall give a receipt or market ticket or licence from the books furnished to him or her for every payment made to him or her and shall keep a strict account of all money received by him or her and shall pay the same into the Treasury at such times and in such manner as he or she may be directed by the Town Warden.

  1.  

    8.   He or she shall produce his or her books, or any property under his or her charge, when called upon to do so by the Town Warden or the Auditor.

  1.  

    9.   All assistants and servants shall be under the direct control of the Market Clerk, and shall perform such duties as may be assigned to them, or required of them, from time to time by the Market Clerk, and any assistant or servants shall when required remain within the precincts of the market at night.

  1.  

    10.   The market shall be opened to the public from 6a.m. to 6p.m. daily, except on Sundays, bank holidays, and on all days which Cabinet may by proclamation declare and appoint to be days of solemn facts or thanksgiving or public holidays when it shall be open from 6a.m. to 9a.m. for the sale of such articles as are permitted to be sold by any law for the time being in force regulating trading on Sundays.

  1.  

    11.   The market may on any day or for any time be temporarily closed by order of the Town Warden, who shall give such directions for the sale of produce, etc., elsewhere as he or she may think fit.

  1.  

    12.   The opening and closing of the market shall be notified by the ringing of the market bell. The opening bell shall be rung once at 6a.m. and the closing bell twice, the first bell for closing shall be rung one hour before the time fixed for closing and every person shall leave the market immediately at the ringing of the second closing bell at 6p.m.

Sale and Disposal of Produce

  1.  

    13.   “Produce” shall mean and include all the articles specified in the Schedule “A” to these rules, and every other article of food for man or beast found, taken, captured, produced, grown, reaped or manufactured in this or any other West Indian country except milk which is hereinafter specially provided for.

  1.  

    14.   “Dispose of,” in these rules shall mean, sell, barter, offer or expose for sale or barter, or cause to be sold, bartered or offered or exposed for sale or barter.

  1.  

    15.   The articles mentioned in Schedule “B” to these rules may be sold in any part of the Town without being taken to the market and without the payment of market dues, but shall be liable to the payment of such dues if and when taken to the market for disposal.

  1.  

    16.   “Market dues” shall mean and include all and any of the dues or charges mentioned in Schedule “C” and referred to in these rules as dues tickets or licences of any kind or howsoever else any money payment may be designated or described.

  1.  

    17.   No person shall dispose of any produce which is not exempt from market dues in any part of the Town or within one mile thereof to any person until such produce has been taken to the market and a market ticket obtained for the disposal of the same, except otherwise specially provided.

  1.  

    18.   No person shall purchase from any hawker any produce upon which market dues are payable unless a market ticket therefor is produced.

  1.  

    19.   A market ticket granted on any day in respect of produce taken to the market shall entitle the holder to sell produce during that day in the market and to the use of one stand or square as may be allotted to him or her by the market clerk or to dispose of such produce outside the market during that day.

  1.  

    20.   No person shall in the Town or within one mile thereof dispose of any produce liable to market dues without having in his or her possession the market ticket or licence obtained in respect thereof.

  1.  

    21.   Any person selling produce, removed from the market, in any store, shop or house may, instead of taking his or her produce to the market daily and removing the same after paying market dues apply for and obtain a monthly or quarterly market licence, which will entitle him or her during the continuance of the licence to sell any such produce in any such store, shop or house without taking such produce to the market daily.

  1.  

    22.   Any person selling produce in the market may instead of obtaining a market ticket for selling such produce on each and every day that he or she sells therein apply for and obtain a monthly stand ticket, which will entitle him or her to the use of the same stand from the date of the ticket to the last day of the current month, with the right to remove produce and return the same into the market at any time during market hours.

  1.  

    23.   A list of all persons selling produce in the Market under monthly tickets shall be posted up in some conspicuous place in the market.

  1.  

    24.   Licences issued for the sale of produce and charcoal in stores, shops, or houses shall be posted up in some conspicuous part of such store, shop, or house, and in the same place from time to time.

  1.  

    25.   No person who has once occupied a stand in the market for the disposal of his or her produce, and has disposed of his or her produce or removed the same outside the market for sale or otherwise shall be entitled to again use such stand without further payment, unless he or she holds a monthly ticket.

  1.  

    26.   No person who has brought his or her produce to the market and elects to sell the same outside the market, shall be entitled to return such produce for sale in the market without further payment unless he or she holds a monthly ticket.

  1.  

    27.   Produce being conveyed to any boat, steamer or vessel for shipment to any other part of the Island shall not be liable to market dues.

  1.  

    28.   The schedules hereinbefore mentioned may at any time be altered, amended, added to, or otherwise changed in any respect by Cabinet and shall have effect from the publication thereof in the Gazette.

Special provisions as the Sale of Charcoal

  1.  

    29.   No person shall dispose of any charcoal in bags or other original packages in the Town or within one mile thereof until such charcoal has been brought to the market and a charcoal ticket obtained for the disposal thereof.

  1.  

    30.   Every charcoal ticket shall entitle the holder to bring into that part of the market appointed for the disposal of charcoal, one bag or other package the contents of which shall not exceed 4 bushels and to dispose of the same in such package or by retail or to take away the original package and sell the same in any part of the Town.

  1.  

    31.   Every person who carries away any original package of charcoal shall have in his or her possession while carrying the same, through the Town or within one mile thereof, the charcoal ticket given in respect thereto and shall produce such ticket on being required to do so by the Town Warden, Market Clerk, or any Market Assistant or Servant, or any police or rural constable.

  1.  

    32.   No person shall dispose of charcoal by retail in any house, shop, store, or other part of the Town or within one mile thereof without a market ticket or a quarterly market licence under rule 21.

  1.  

    33.   The provision of rule 22 with respect to the use of monthly tickets for the disposal of other produce in the market shall apply to the disposal of charcoal therein by retail.

Special provisions as to Sale of Syrup, Sugar, & Molasses

  1.  

    34.   No person shall sell sugar, syrup or molasses in any house, shop, store, street or in any place in the Town or within one mile thereof without a market ticket or a quarterly market licence.

  1.  

    35.   Market tickets and licences for the disposal of sugar, syrup or molasses kept for sale in any house, store, shop or other place may be obtained from the Market Clerk without such produce being taken to the market. Provided that a sale shall not be made without such ticket or licence.

Sale and Slaughter of Cattle and the Disposal of Meat

  1.  

    36.   “Cattle” shall mean the male, female and young of any kind, sheep, goat or swine, and “animal” shall include any cattle, and “meat” shall mean every part of any slaughtered cattle except skin, horns and hoofs.

  1.  

    37.   “Slaughterer” shall mean a person licensed by the Town warden to slaughter animals at the slaughter house.

  1.  

    38.   Every person desiring to be licensed as slaughterer in the market shall make application in writing to the Town Warden and if the Town Warden is satisfied that he or she is a fit an proper person to be licensed he or she shall order the Market Clerk to issue a licence to him or her on the payment of the fee prescribed in the Schedule of dues.

  1.  

    39.   The Town Warden may at any time cancel the licence of any slaughterer for any misconduct, disobedience or orders or breach of any market regulation.

  1.  

    40.   No person shall sell any cattle in any part of the Town without first bringing the same to the market and paying cattle dues thereon.

  1.  

    41.   No cattle shall be slaughtered in any part of the Town or within one mile thereof except at the slaughter house, and by a slaughterer.

  1.  

    42.   A slaughterer shall not slaughter any cattle as the slaughter house unless the receipt issued by the Market Clerk for the dues payable in respect to the animal to be slaughtered is handed to him or her, which receipt he or she shall keep as his or her authority.

  1.  

    43.   Any cattle intended for slaughter must be exhibited to the Market Clerk, and if the Market Clerk is satisfied that the animal is fit for food and is not in young he or she shall collect the slaughter house dues and issue a receipt for each animal.

  1.  

    44.   Any cattle which in the opinion of the Market Clerk is unfit for food shall not be slaughtered until examined by a medical officer and a certificate that it is fit for food produced.

  1.  

    45.   No meat which is in the opinion of the Market Clerk unfit for food shall be sold or offered for sale until the same has been examined by a Medical Officer and a certificate of soundness produced.

  1.  

    46.   The Medical Officer will be entitled to a fee according to the Schedule to be paid in the first instance by the owner of the suspected animal which fee will be refunded by the Market Clerk immediately on a certificate of soundness being produced to him or her unless the Medical Officer certifies that there was good reason for suspecting a diseased condition.

  1.  

    47.   No person shall sell or offer for sale or expose for sale any meat in any part of the Town or within one mile thereof except the market and in no other part of the market except the stalls or other place provided for the purpose and all meat so sold or offered for sale may be seized by the Town Warden, Market Clerk or any Police Constable and shall be forfeited and sold at the market and the proceeds paid into the Treasury to the credit of the Market fund.

Sale of fish and Turtle

  1.  

    48.   “Fish” means any kind of uncooked sea fish or turtle.

  1.  

    49.   “Stale fish” means any uncooked fish found in the possession of any person or being offered or exposed for sale after 9p.m.

  1.  

    50.   No person shall dispose of fish in any part of the Town except the market and at the stalls provided and except as hereinafter provided.

  1.  

    51.   No person shall dispose of fish on any other day than that on which it has been taken from the sea, and “day” for the purposes of this rule shall mean from 1a.m. to 9p.m.

  1.  

    52.   Any fish remaining unsold at the market at the closing hour may, if the Market Clerk is satisfied that the same is sound and fit for food, be removed from the market to such place as may from time to time be appointed by the Town Warden for the purpose and sold, salted or otherwise disposed of before 9p.m., otherwise it shall be destroyed.

  1.  

    53.   Every person removing fish for sale from the market at the closing hour, shall obtain a market ticket for that purpose and shall produce such ticket when required to do so by the Town Warden, Market Clerk or any Police or Rural Constable.

  1.  

    54.   Any fish arriving on shore after the closing hour, if the Market Clerk is satisfied that the same is sound and fit for food, shall be disposed of by any licensed fish stall holder at the place and before the hour set out in Rule 52 hereof, and not otherwise.

  1.  

    Such fish, obtain a market ticket for that purpose and pay the sum of 2¢ therefor as set out in Schedule “C” to these Rules. He or she shall also produce such ticket on demand as provided for in Rule 53 of these Rules.

  1.  

    56.   Any seller of fish who shall sell stale or rotten fish or in whose possession any stale or rotten fish shall be found guilty of an offence against these Rules.

  1.  

    57.   All fish brought to or found in the market which the Market clerk considers unfit for food shall be destroyed by order of the Town Warden or the Medical Officer.

  1.  

    58.   All turtle shall be slaughtered at the slaughter house by the slaughterer.

  1.  

    59.   No person shall sell turtle in any other part of the market than at a fish or meat stall.

Special provisions for the Sale of Milk

  1.  

    60.   No person shall sell milk in any dwelling house, shop, store, street, or other place in the Town or within one mile thereof without first obtaining a Quarterly Market licence to do so.

  1.  

    61.   Any person who is found conveying or selling , or who is proved to have sold milk in the Town or within one mile thereof which has in anyway been adulterated by the addition of water or any other foreign substance shall be liable to a penalty not exceeding $24 and in addition in the discretion of the convicting Magistrate to have his or her licence suspended or cancelled.

  1.  

    62.   Any person licensed to sell milk, shall be bound to permit his or her milk to be tested by the Town Warden or by any person appointed by him or her for the purpose, and the Warden or any person so appointed shall have a right to go into any dwelling house, shop, store, or other place, or stop any person in the street for the purpose of testing milk.

  1.  

    63.   All licences issued for the sale of milk shall have effect from the day of issue to the last day of the current quarter ending as the case may be on the last day of the month of March, June, September or December.

  1.  

    64.   All milk offered or exposed for sale may be tested by the Town Warden or any person authorised by him or her, and such test may be made by a lactometer, or by any other sufficient means, and any milk with a density less than 1051 shall be considered adulterated milk and shall be liable to be destroyed by order of the Town Warden.

  1.  

    65.   All milk being conveyed through the Town for sale or exposed in any place in the Town for sale shall be conveyed or kept in clean vessels, and be covered so as to prevent any foreign substance getting into the milk.

Provisions as to Stalls and Stands

  1.  

    66.   No person shall be entitled to make use of any stall or stand until he or she has paid the dues set in the Schedule of market dues.

  1.  

    67.   Any person who shall make use of any stall or stand without the payment above mentioned, shall be liable to a penalty as hereinafter provided in addition to the dues payable in respect thereof.

  1.  

    68.   Any person not being a licensed butcher, who in any place and through accident or other unavoidable circumstances is obliged to slaughter any cattle, wishes to dispose of the meat at the market shall before bringing the meat to the market obtain a permission from the Market Clerk to do so, and shall, if on the inspection of the meat, the Market Clerk is satisfied that it is sound and fit for food, be entitled to sell the same in a stall or other place appointed by the Market Clerk in the market on the payment of the daily dues prescribed in the Schedule for the use of a stall.

  1.  

    69.   The Town Warden or Market Clerk, may refuse to allow any person who has been twice convicted of any offence with respect to any stall or stand to have the use of any stand or stall in the market, for such time as he or she may think proper.

  1.  

    70.   Except in the case of a registered firm or partnership no stall or stand shall be allotted to more than one person at the same time.

  1.  

    71.   The holder of any stall or stand shall keep his or her stall or stand and all tools and other trade appliances in thorough cleanliness at all time, and in respect thereto shall immediately carry out all instructions given by the Market Clerk. And before leaving the market for the day, thoroughly cleanse to the satisfaction of the Market Clerk his or her stall, stand or square, counter, tools, and other appliances and shall remove the refuse therefrom and place the same in the receptacle or place provided for the purpose.

  1.  

    72.   Every seller of meat, turtle or fish shall be cleanly dressed and shall wear a clean apron.

  1.  

    73.   Every person who carries meat, fish or turtle into the market shall be cleanly dressed.

  1.  

    74.   No person shall chop any meat, fish or turtle except on blocks approved for the purpose by the Market Clerk.

  1.  

    75.   No person shall be allowed to be in any meat or fish stall except the holder, his or her seller and assistants, without the permission of the Market Clerk.

  1.  

    76.   Nothing shall be kept, or offered, for sale in any meat or fish stall except meat, fish and turtle, and turtle shall be kept separate.

  1.  

    77.   The holder of every stall or stand is liable for any offence committed in respect of such stall or stand.

  1.  

    78.   No holder of a stand ticket shall allow any produce not being his bona fide property to be placed thereon for sale or otherwise; and shall not allow his or her produce to extend beyond the limits of his or her stand.

  1.  

    79.   Every seller at a stand shall produce his or her market ticket when required to do so by the Town Warden or the Market Clerk.

  1.  

    80.   Any person who introduces into the market any produce without the payment of market dues, is liable to pay treble market dues; and if he or she refuses to do so the produce shall be detained by the Market Clerk until the dues are paid, and if such dues are not paid before 5p.m. that day the produce shall be forfeited and the Market Clerk shall sell the same to the highest bidder, and pay the proceeds to the Town Warden. Provided that the Town Warden may after deducting the treble market dues and a fine not exceeding 48¢ refund the balance to the owner.

  1.  

    81.   Any person in the possession of a monthly stand ticket or of a monthly or weekly stall ticket shall be entitled at his or her own risk to leave produce in the market during any night or on Sundays and public holidays.

  1.  

    82.   Any person having a stand ticket for a day, shall remove his or her produce from the market at the closing hour, unless he or she pays in advance for the use of the stand on the next following day.

  1.  

    83.   The Market Clerk may appoint places outside of the market buildings for the sale of grass and other produce which in his or her opinion should not be brought into the building.

  1.  

    84.   The Market Clerk may permit any article not specially provided for in these Rules or in the Schedules hereto to be sold in the market on the payment of stand, stall, or other market dues.

Unwholesome Food

  1.  

    85.   The Market Clerk shall seize and detain all articles of food found on any stand or in any stall or other part of the market which in his or her opinion are unfit for food; and the same shall be destroyed by order of the Town Warden after he or she has inspected the same and satisfied himself or herself of its unsoundness. Provided that the owner of person in charge may have the same inspected by a medical officer at any time within 2 hours, whose decision in the matter shall be final, and the medical officer shall be entitled to a fee according to the Schedule to be paid in the first instance by the applicant and which fee shall so soon as the medical officer certifies that such food is sound and fit for food.

Miscellaneous Offences

  1.  

    86.   Every person in the market who shall refuse to obey the orders of the Market Clerk, and any person found loitering or wandering about the market shall leave immediately on being ordered by the Market Clerk, or otherwise be ejected by the Market Clerk, any assistant or servant, or any Police or Rural Constable, and commits an offence against these Rules.

  1.  

    87.   Every person who shall do any of the following acts commits an offence against these Rules—

    1.  

      1.     Smoke in the market.

    1.  

      2.     Sit or lie on any block, counter, table, or stand in the market or on the pavement thereof.

    1.  

      3.     Sharpen any instrument on any part of the market structure.

    1.  

      4.     Use any obscene, abusive or insulting language or swear or otherwise misbehave in the market.

    1.  

      5.     Fight or create or cause to be created any row, riot or disturbance in the market.

    1.  

      6.     Throw any dirt, filth, rubbish or litter in the market.

    1.  

      7.     Break, cut, pull down, destroy, remove, injure or spoil any part of the market.

    1.  

      8.     Be in the market during the hours that the market is not open to the public and does not leave when required to.

    1.  

      9.     Dispose of in any part of the market anything other than that which is allowed at such part for the time being.

    1.  

      10.     Solicit custom or cause the same to be done in any part of the market not being a stall, stand or square.

    1.  

      11.     Advertise in any part of the market outside of any stall, stand or square any wares or the price thereof by cries, shouts or otherwise or cause the same to be done.

    1.  

      12.     Introduce, dispose of, or consume, any wine, malt liquor, spirits or intoxicants of any kind in the market.

    1.  

      13.     Take or bring any dog or permit any dog to follow or accompany him or her into the market, or to be with him or her in the market.

    1.  

      14.     Light any fire in the market, or cook therein, except in such parts thereof and under such conditions as may from time to time be pointed out and allowed by the Market Clerk.

    1.  

      15.     Commit a nuisance in, on, or at any part of the market.

    1.  

      16.     Use any urinal otherwise than for the purpose for which it was intended.

    1.  

      17.     Any male who goes into any urinal provided for the use of females and any female who goes into any urinal provided the use of males.

    1.  

      18.     Remove refuse from any part of the market in such a manner as to create a nuisance in the process of removal.

    1.  

      19.     Without the consent of the Market Clerk place, deposit or throw anything in or on, any part of the market not appointed for the disposal of produce.

    1.  

      20.     Place or keep any hide in any part of the market other than that appointed from time to time for the purpose.

  1.  

    88.   Any poultry found trespassing in any part of the market may be seized or killed, and immediately sold, and the proceeds paid into the market fund.

  1.  

    89.   No person affected with any loathsome or contagious disease or sores shall be allowed in the market and if found therein shall be immediately required to leave and on his or her refusal be ejected therefrom by the Market Clerk, or any servant or Police or Rural Constable.

  1.  

    90.   Every person who shall commit a breach of any of the rules hereinbefore defined, or who shall obstruct, resist, molest or interfere with the Town Warden, Market Clerk, Licensed Slaughterer, or any of their assistants in the execution of their duty or who shall refuse or neglect to obey any instructions issued by the Town Warden or the Market Clerk with respect to any rules commits an offence and being convicted is liable in cases where no other penalty is hereinbefore prescribed to a penalty not exceeding $24, and in default of payment to imprisonment with or without hard labour for any term not exceeding one month.

Forms and Procedure

  1.  

    91.   Market tickets, receipts, licences or any other documents required to be issued under these Rules shall be in such form, as may from time to time be prescribed by the Town Warden.

  1.  

    92.   Every proceeding instituted under these Rules shall be in the name and at the instance of the Town Warden before the District Court and the procedure shall be the same as the procedure for the time being in force in respect of offences punishable on summary conviction, provided that the Town Warden may authorise in writing the Market Clerk or any Police Officer in charge of the Police Station to appear and prosecute any charge made by him or her.

2A.   Soufriere Gardens
  1.  

    1.   The Warden shall be in charge of the Gardens.

  1.  

    2.   The Gardens except as provided by these Rules shall be opened to visitors from 6a.m. to 9p.m.

  1.  

    3.   Visitors must be decently clad and must conduct themselves in an orderly manner.

  1.  

    4.   No visitor shall carry any load through, or into the Gardens or shall sell or expose for sale any article whatsoever, or shall deposit bottles, paper or rubbish of any kind in the Garden.

  1.  

    5.   No vehicle shall be brought into the Gardens.

  1.  

    6.   No poultry or animals, save dogs in leash and under control are allowed in the Gardens.

  1.  

    7.   No visitor shall cause annoyance, inconvenience or obstruction to other visitors, or interfere with any water or other appliances in the Gardens.

  1.  

    8.   Visitors shall not pick, handle, gather, cut, or collect any fruit, flower, plant, branch or portion thereof, or carry away fallen fruit, or in any way injure any tree, plant or shrub, growing in any part of the Gardens.

  1.  

    9.   Games of all kinds are prohibited in the Gardens.

  1.  

    10.   Public meetings or speaking for political or other purposes are not allowed in the Gardens.

  1.  

    11.   No person shall sing or play or attempt to play any musical instrument in the Gardens, without the permission of the Warden.

  1.  

    12.   Any person acting contrary to these Rules may be summarily removed from the Gardens by the Warden or person acting under his or her orders, and in addition is liable on summary conviction to a penalty not exceeding $24.

2B.   Soufriere fire brigade
  1.  

    1.   There shall be established a Soufriere Town Fire Brigade.

  1.  

    2.   The Brigade shall consist of not more than 12 fit and proper residents of the Town and be selected and removable by the Town Warden together with such members of the Police Force stationed at Soufriere as may be detailed by the Superintendent of Police from time to time for the purpose.

  1.  

    3.   The Brigade, the Fire Fighting Apparatus and the Fire Station provided out of the Town Fund shall be under the general supervision of the Warden, but in the event of a fire or fire alarm the Brigade shall be under the orders of the senior Police Fireman or the first Police Fireman to reach the scene of the fire, as the case may be.

  1.  

    4.   On the first alarm of any fire in the Town of Soufriere, the senior Police Fireman and the Fire Brigade shall promptly repair to the Fire Station and convey the Fire Fighting Apparatus with all possible dispatch to the scene of the fire, and shall exercise their best efforts to extinguish the same.

  1.  

    5.   The senior Police Fireman may interrupt traffic if in his or her opinion such interruption is necessary for extinguishing the fire, and may subject as aforesaid demolish or remove any erection necessary to be removed to control the fire.

  1.  

    6.   The Fire Brigade shall be paid such sums for attendance at drills and fires as may be determined from time to time from the Town Fund subject to the approval of Cabinet.

  1.  

    7.   The Fire Brigade may be given a distinguishing badge which shall be worn on duty.

  1.  

    8.   No liability shall attach to the Fire Brigade or the members thereof for any damage or for any act caused or done bona fide in the exercise of the powers and duties conferred and imposed by these Rules, and such damage shall be deemed to be damage done by fire for the purposes of any Policy of Insurance affecting the same.

  1.  

    9.   In the discretion of the Warden or in his or her absence of the senior Police Fireman the Brigade may attend fires outside the Town Boundaries.

2C.   Licences (Soufriere)

(Statutory Instruments 89/1940 and 8/1943)

  1.  

    1.   Citation

These Rules may be cited as the Licences (Soufriere) Rules.

  1.  

    2.   Hawking Licence

  1.  

    (1)   A Hawking Licence may be issued by the Town Warden of Soufriere on payment of the prescribed fee and may be renewed by the endorsement of the renewal thereof by the Town Warden on the original licence, and each renewal shall be subject to the same fee as the original licence.

  1.  

    (2)   No person shall hawk goods or merchandise (other than those which under any law must be disposed of in the market) in the Town of Soufriere or within one mile thereof unless he or she has first taken out licence to do so under these Rules.

  1.  

    (3)   A licence issued or renewed shall continue in force for the period of a month and shall expire on the first working day after the end of the month in which it was issued or renewed.

  1.  

    3.   Fee

A fee of 72¢ shall be paid into the Treasury to the credit of the Soufriere Town Fund in respect of every Hawking Licence.

  1.  

    4.   Hand-Cart Licences

  1.  

    (1)   A Hand-Cart Licence may be issued by the Town Warden of Soufriere on payment of the prescribed fee and may be renewed by the endorsement of the renewal thereof by the Town Warden on the original licence, and each renewal shall be subject to the same fee as the original licence.

  1.  

    (2)   No person shall own or use a hand-cart in the Town of Soufriere or within one mile of the limits thereof unless he or she has obtained a licence under the preceding sub-rule.

  1.  

    (3)   A licence issued or renewed shall continue in force for the period of one year and shall expire on 31 December in each year.

  1.  

    (4)   A licence may be issued for a half-year, and shall expire on 30 June or 31 December as the case may be.

  1.  

    5.   Fees

A fee of 60¢ in respect of every yearly hand-cart licence, and of 30¢ in respect of every half-yearly hand-cart licence shall be paid into the Treasury to the credit of the Soufriere Town Fund in respect of every hand-cart licence.

  1.  

    6.   Production of licence

Any person holding a licence under these Rules shall keep such licence in his or her possession and shall produce the same to any police officer or the Soufriere Market Clerk immediately on his or her being requested so to do.

  1.  

    7.   Penalty

Any person who contravenes any of the provisions of these Rules is liable on summary conviction to a penalty not exceeding $24.

3.   Licences (Vieux-Fort)

    1.   Citation

These Rules may be cited as the Licences (Vieux-Fort) Rules.

    2.   Hawking Licence

  1.

    3.   Porter's Licence

  1.  

    (1)   A Porter's Licence may be issued by the Town Warden of Vieux-Fort on payment of the prescribed fee and may be renewed by the endorsement of the renewal thereof by the Town Warden on the original licence, and each renewal shall be subject to the same fee as the original licence.

    (2)   No person shall do any work as a porter in the Town of Vieux Fort unless he or she has first taken out a licence to do so under these Rules.

    (3)   A licence issued or renewed shall continue in force until the first working day after 30 June or 31 December then next following.

Any person holding a licence under these Rules shall keep such licence in his or her possession and shall produce the same to the Town Warden or to any person authorised by him or her in writing or to any police officer immediately on his or her being requested so to do.

  1.  

    5.   Fees

The following fees shall be paid into the Treasury to the credit of the Vieux Fort Town Fund in respect of the licences issued under these Rules:

Hawking Licence     72¢

Porter's Licence     24¢.

  1.  

    6.   penalty

Any person who contravenes any of the provisions of these Rules is liable on summary conviction to a penalty not exceeding $24.

4.   Choiseul Market

The appointment of the Market, its Control and Management

  1.  

    1.   The Choiseul Market shall mean the market house erected for the purpose and shall include the stalls for selling meat and any place appointed by the Town Warden for slaughtering cattle, the sale of fish and charcoal and any land enclosed, set aside or appropriated for the use and purpose of the market.

  1.  

    2.   The market shall be under the supervision and control of the Town Warden, hereinafter referred to as the Warden, who may, subject to the approval of Cabinet, appoint such assistants and servants as may be necessary from time to time, and any assistant performing duties delegated to him or her in respect of the market or the disposal of produce, shall subject to the orders of the Warden have all the powers of the Warden.

  1.  

    3.   The Warden shall collect the dues prescribed in Schedule “C” and shall give receipts and market licences from the books furnished to him or her for every payment made to him or her and shall keep a strict account of all moneys received by him or her and shall pay the same into the Treasury at the close of each month, and shall be entitled to a commission of 10% on the moneys so collected and paid into the Treasury.

  1.  

    4.   The market house and meat stalls shall be open to the public from 6a.m. to 6p.m. daily, except on Sundays, Bank-holidays and on all days which Cabinet may declare and appoint to be days of solemn fast or thanksgiving or public holidays when they shall be open from 6 to 9a.m. for the sale of such articles as are permitted to be sold by any law for the time being in force regulating trade on Sundays.

  1.  

    5.   The Warden may close the market house on any day or for any time and shall give directions for the sale of produce elsewhere as he or she may think fit.

  1.  

    6.   The Warden shall appoint places in the Village for selling fish, turtle and charcoal and for slaughtering cattle and may change such places from time to time or may approve of any other place being used temporarily for the purpose in addition to such appointed places.

Sale and Disposal of Produce

  1.  

    7.   “Produce” shall mean and include all the articles specified in Schedule “A” to these Rules and every other article of food for man or beast found, taken, captured, produced, grown, reaped, or manufactured in Saint Lucia or any other West Indian country except such articles as are specified in Schedule “B” and such produce as is being conveyed to any steamer, vessel or boat for shipment to any other part of the Island.

  1.  

    8.   “Dispose of” shall mean sell, barter, offer or expose for sale or barter or cause to be sold, bartered or offered or exposed for sale or barter.

  1.  

    9.   No person shall dispose of any produce in the market or in any house, store, shop, street, road or in any public or other place in the Village or within one mile thereof without first obtaining a licence from the Warden or any person acting for him or her for the disposal of the same in keeping with Schedule “C” of these Rules.

  1.  

    10.   No person shall purchase any produce from any person who is not possessed of a licence to sell such produce as hereinbefore provided.

  1.  

    11.   The Warden shall cause a list of all licences issued by him or her to be posted up in some conspicuous place in the market and Police Station.

  1.  

    12.   All produce brought to the Village by sea shall be disembarked on the jetty or landed on the beach within 100ft. of either side of the jetty, and at no other place.

  1.  

    13.   No produce shall be offered or exposed for sale in any street or public place except between the hours of 6a.m. and 6p.m. and only on such days as produce may lawfully be sold in the market house as hereinbefore provided.

  1.  

    14.   No produce shall be exposed for sale in any house, store or shop on any market day after 8 p.m.

Slaughter of Cattle and Sale of Meat

  1.  

    15.   Cattle shall mean the male and female of any kine, sheep, goat or swine, and meat shall mean every part of any slaughtered cattle except the skin, horns and hoofs.

  1.  

    16.   No cattle shall be slaughtered in any part of the Village or within one mile thereof accept at such place as may be appointed or approved of by the Warden.

  1.  

    17.   No person shall sell or offer or expose for sale any meat in any part of the Village or within one mile thereof except at the stalls provided for the purpose, and no person shall make use of any stall until he or she has paid the dues set out in Schedule “C”.

  1.  

    18.   Except in the case of a registered firm or partnership no meat stall shall be allotted to more than one person and no person shall be permitted to have the use of more than one stall, and any person to whom a stall is allotted who permits any butcher or other person to sell meat in his or her stall without the permission of the Warden, and every person who combines with any other person to rent a stall for the purpose of allowing any one person to use more than one stall, or for the purpose of any combination or monopoly in the butchers' trade commits an offence against these Rules.

  1.  

    19.   The holder of any stall shall keep his or her stall and all tools and other trade appliances in thorough cleanliness at all times.

  1.  

    20.   Every seller of meat in a stall shall be cleanly dressed and shall wear a clean apron, otherwise he or she may be ejected therefrom by any Police or Rural Constable on the order of the Warden.

  1.  

    21.   Every person who carries meat into any stall shall be cleanly dressed.

  1.  

    22.   No person except the holder, his or her seller or assistant shall be allowed in any meat stall without the permission of the Warden.

  1.  

    23.   No person shall chop any meat in the stalls except on blocks approved by the Warden.

  1.  

    24.   Nothing shall be kept or offered for sale in any stall except meat, without the permission of the Warden.

  1.  

    25.   The holder of every stall is liable for any offence committed in respect of such stall.

  1.  

    26.   The holding of any stall shall be for one month or for one day and the Warden may refuse to rent a stall to any person, and the allotting of stalls at the beginning of every month or on any day shall be in the discretion of the Warden.

Sale of Fish and Turtle

  1.  

    27.   Fish means any kind of uncooked sea fish or turtle, and tale fish means any such fish found in the possession of any person after 9p.m.

  1.  

    28.   No person shall dispose of fish on any day, other than the day upon which it has been taken from the sea, and “day” shall mean the time between 1 a.m. and 9 p.m. of any day.

  1.  

    29.   No person shall sell or offer or expose for sale any fish in any part of the Village or within one mile thereof except in such place as shall be appointed or approved by the Warden.

  1.  

    30.   No person shall sell rotten fish at any time or in any place.

  1.  

    31.   All stale fish except it be cleaned and salted or is being sold or offered for sale by permission of the Warden, after 9 p.m. is liable to be seized by the Warden or any Police Constable and destroyed, and every person in whose possession stale fish is found, without such permission commits an offence against these Rules.

Sale of Milk

  1.  

    32.   Any person who is found conveying or selling or offering for sale or who is proved to have sold milk in the Village or within one mile thereof which has in any way been adulterated with water or any foreign substance commits an offence against these Rules.

  1.  

    33.   All milk kept, offered or exposed for sale in the Village or within one mile thereof, may be tested by the Warden or any person authorised by him or her with a lactometer or by other sufficient means and any milk with a density less than 1051 shall be considered adulterated, and is liable to be seized and destroyed by order of the Warden, and the Warden or any person authorised by him or her shall have a right to go into any store, shop, dwelling house or other place or stop any person in any street, road, public or other place for the purpose of testing milk so kept, offered or exposed for sale.

  1.  

    34.   All milk being kept, conveyed or exposed for sale in the Village or within one mile thereof shall be kept or conveyed in clean vessels and be covered so as to prevent flies, insects or other foreign substance getting into the milk.

  1.  

    35.   Any person who shall wilfully throw, deposit or place any water or other foreign substance in any milk which is kept, or being conveyed or offered or exposed for sale in any place commits an offence against these Rules.

Sale of Charcoal

  1.  

    36.   All charcoal in bags or other original packages brought into the Village shall be deposited in the market or place appointed by the Warden, and any person who shall deposit such charcoal in any other place or who shall remove such charcoal therefrom without a licence first obtained for the disposal thereof commits an offence against these Rules.

  1.  

    37.   Any person who permits any charcoal in bags or other original packages to be deposited in his or her store, shop, house or on his or her land, or in whose possession such charcoal is found contrary to the provisions of the foregoing rule commits an offence against these Rules.

Miscellaneous Offences

  1.  

    38.   Every person who shall any of the following act commits an offence against these Rules—

    1.  

      1.     Smoke in the market or bring or light any fire in the market.

    1.  

      2.     Sit, stand on, lie on any block, counter, table in the market.

    1.  

      3.     Do any damage to any part of the market.

    1.  

      4.     Use any obscene, abusive or insulting language or swear or sing, or shout, or fight, or create any disorder, or do any obscene act in the market.

    1.  

      5.     Throw any dirt, filth, rubbish or litter in the market.

    1.  

      6.     Bring or allow any dog to follow him or her into the market, or to remain therein.

  1.  

    39.   Any poultry found trespassing in the market may be seized or killed by any person, and immediately sold by the Warden or any Police Constable and the proceeds paid into the Treasury to the credit of the Market Fund.

  1.  

    40.   No person affected with any loathsome or contagious disease, or with sores shall go into the market, and if found therein, shall leave immediately on being requested to do so by the Warden, any Police Constable, assistant or servant.

  1.  

    41.   Every person who shall refuse to obey the orders for the Warden whether issued by himself or herself or through a Police Constable, assistant or servant with respect to any rule commits an offence against these Rules.

  1.  

    42.   Every person who shall commit a breach of any of the rules hereinbefore defined or who shall obstruct, resist, molest or interfere with the Warden or any assistant or servant or Police Officer in the execution of their duties prescribed by any such rules, commits an offence and being convicted is liable to a penalty not exceeding $24 and in default of payment to imprisonment with or without hard labour for any term not exceeding one month.

Dues

  1.  

    43.   The dues set out in Schedule “C” shall be the dues payable under these Rules, and such Schedule, and also Schedules “A” and “B” may be altered, amended, added to or otherwise changed by Cabinet and any such change shall have effect from the publication thereof in the Gazette.

  1.  

    44.   Market receipts, licences or any other document required to be issued under these Rules may be in such form as the Warden may prescribe from time to time.

  1.  

    45.   Every proceeding instituted under these Rules shall be in the name and at the instance of the Warden before the District Court and the procedure shall be the same as the procedure for the time being in force in respect of Summary Offences, provided that the Warden may authorise in writing any Police Officer in charge of a Police Station to appear and prosecute any charge made by him or her.

    16.   Every person desiring to be licensed as a slaughterer in the Market shall make application in writing to the Warden and if the Warden is satisfied that he or she is a fit and proper person to be licensed shall issue a licence to him or her on the payment of the fee prescribed in the Schedule of Dues.

  1.  

    17.   The Warden may at any time cancel the licence of any slaughterer for any misconduct, disobedience of orders or breach of any Market Rules.

  1.  

    18.   No person shall sell any cattle in any part of the Village without first bringing the same to the Market and paying cattle dues thereon.

  1.  

    19.   No cattle shall be slaughtered in any part of the Village or within one mile thereof except at the slaughter house or such place appointed by the Warden, and by a slaughterer.

  1.  

    20.   A slaughterer shall not slaughter any cattle at the slaughter house unless the receipt issued by the Market Clerk for the dues payable in respect to the animal to be slaughtered is handed to him or her, which receipt he or she shall keep as his or her authority.

  1.  

    21.   Any cattle intended for slaughter must be exhibited to the Market Clerk, and if the Market Clerk is satisfied that the animal is fit for food and is not in young he or she shall collect the slaughter house dues and issue a receipt for each animal.

  1.  

    22.   Any cattle which in the opinion of the Market Clerk is unfit for food shall be sold or offered for sale until the same has been examined by a Medical Officer and a certificate of soundness produced.

  1.  

    23.   No meat which is in the opinion of the Market Clerk unfit for food shall be sold or offered for sale until the same has been examined by a Medical Officer and a certificate of soundness produced.

  1.  

    24.   The Medical Officer will be entitled to a fee according to the Schedule to be paid in the first instance by the owner of the suspected animal which fee will be refunded by the Market Clerk immediately on a certificate of soundness being produced to him or her unless the Medical Officer certifies that there was good reason for suspecting a diseased condition.

  1.  

    25.   No person shall sell or offer or expose for sale any meat in any part of the Village or within one mile thereof except at the stalls provided for the purpose, and no person shall make use of any stall until he or she has paid the dues set out in Schedule “C”.

  1.

6.   Micoud Market

The appointment of the Market, its Control and Management

  1.  

    1.   The Micoud Market shall mean the market house erected for the purpose and shall include the slaughter house, fish and other stalls and any place appointed by the Town Warden for slaughtering cattle, the sale of fish and charcoal and any land enclosed, set aside or appropriated for the use and purpose of the market.

  1.  

    2.   The market shall be under the supervision and control of the Town Warden, hereinafter referred to as the Warden, who may, subject to the approval of Cabinet, appoint such assistants and servants as may be necessary from time to time, and any assistant performing duties delegated to him or her in respect of the market or the disposal of produce, shall subject to the orders of the Warden have all the powers of the Warden.

  1.  

    3.   The Warden shall collect the dues prescribed in Schedule “C” and shall give receipts and market licences from the books furnished to him or her for every payment made to him or her and shall keep a strict account of all moneys received by him or her and shall pay the same into the Treasury at the close of each week.

  1.  

    4.   The market shall be open to the public from 6a.m. to 6p.m. daily, except on Sundays, Bank-holidays and on all days which Cabinet may declare and appoint to be days of solemn fast or thanksgiving or public holidays when it shall be open from 6 to 9a.m. for the sale of such articles as are permitted to be sold by any law for the time being in force regulating trade on Sundays.

  1.  

    5.   The Warden may close the market on any day or for any time, and shall give directions for the sale of produce elsewhere as he or she may think fit.

Sale and Disposal of Produce

  1.  

    6.   “Produce” shall mean and include all the articles specified in Schedule “A” to these Rules and every other article of food for man or beast found, taken, captured, produced, grown, reaped, or manufactured in Saint Lucia or any other West Indian country except such articles as are specified in Schedule “B” and such produce as is being conveyed to any steamer, vessel or boat for shipment to any other part of the Island.

  1.  

    7.   “Dispose of” shall mean sell, barter, offer or expose for sale or barter or cause to be sold, bartered or offered or exposed for sale or barter.

  1.  

    8.   No person shall dispose of any produce in the market or in any house, store, shop, street, road or in any public or other place in the Village or within one mile thereof without first obtaining a licence from the Warden or any person acting for him or her for the disposal of the same in keeping with Schedule “C” of these Rules.

  1.  

    9.   No person shall purchase any produce from any person who is not possessed of a licence to sell such produce as hereinafter provided.

  1.  

    10.   The Warden shall cause a list of all licences issued by him or her to be posted up in some conspicuous place in the market and Police Station.

  1.  

    11.   All produce brought to the Village by sea shall be disembarked on the jetty or landed on the beach within 100ft. of either side of the Police Station, and at no other place without the permission of the Warden.

  1.  

    12.   No produce shall be offered or exposed for sale in any street or public place except between the hours of 6a.m. and 6p.m. and only on such days as produce may lawfully be sold in the market house as hereinbefore provided.

  1.  

    13.   No produce shall be exposed for sale in any house, store or shop on any market day after 8 p.m.

Sale and Slaughter of Cattle and Disposal of Meat

  1.  

    14.   Cattle shall mean the male and female and young of any kine, sheep, goat or swine, and animal shall include any cattle, and meat shall mean every part of any slaughtered cattle except the skin, horns and hoofs.

  1.  

    15.   Slaughterer shall mean a person licensed by the Warden to slaughter animals at the slaughter house.

  1.  

    16.   Every person desiring to be licensed as a slaughterer in the Market shall make application in writing to the Warden and if the Warden is satisfied that he or she is a fit and proper person to be licensed shall issue a licence to him or her on the payment of the fee prescribed in the Schedule of Dues.

  1.  

    17.   The Warden may at any time cancel the licence of any slaughterer for any misconduct, disobedience of orders or breach of any Market Rules.

  1.  

    18.   No person shall sell any cattle in any part of the Village without first bringing the same to the Market and paying cattle dues thereon.

  1.  

    19.   No cattle shall be slaughtered in any part of the Village or within one mile thereof except at the slaughter house or such place appointed by the Warden, and by a slaughterer.

  1.  

    20.   A slaughterer shall not slaughter any cattle at the slaughter house unless the receipt issued by the Market Clerk for the dues payable in respect to the animal to be slaughtered is handed to him or her, which receipt he or she shall keep as his or her authority.

  1.  

    21.   Any cattle intended for slaughter must be exhibited to the Market Clerk, and if the Market Clerk is satisfied that the animal is fit for food and is not in young he or she shall collect the slaughter house dues and issue a receipt for each animal.

  1.  

    22.   Any cattle which in the opinion of the Market Clerk is unfit for food shall be sold or offered for sale until the same has been examined by a Medical Officer and a certificate of soundness produced.

  1.  

    23.   No meat which is in the opinion of the Market Clerk unfit for food shall be sold or offered for sale until the same has been examined by a Medical Officer and a certificate of soundness produced.

  1.  

    24.   The Medical Officer will be entitled to a fee according to the Schedule to be paid in the first instance by the owner of the suspected animal which fee will be refunded by the Market Clerk immediately on a certificate of soundness being produced to him or her unless the Medical Officer certifies that there was good reason for suspecting a diseased condition.

  1.  

    25.   No person shall sell or offer or expose for sale any meat in any part of the Village or within one mile thereof except at the stalls provided for the purpose, and no person shall make use of any stall until he or she has paid the dues set out in Schedule “C”.

  1.  

    26.   Except in the case of a registered firm or partnership no meat stall shall be allotted to more than one person and no person shall be permitted to have the use of more than one stall, and any person to whom a stall is allotted who permits any butcher or other person to sell meat in his or her stall without the permission of the Warden, and every person who combines with any other person to rent a stall for the purpose of allowing any one person to use more than one stall, or for the purpose of any combination or monopoly in the butchers' trade commits an offence against these Rules.

  1.  

    27.   The holder of any meat stall shall keep his or her stall and all tools and other trade appliances in thorough cleanliness at all times.

  1.  

    28.   Every seller of meat in a stall shall be cleanly dressed and shall wear a clean apron, otherwise he or she may be ejected therefrom by any Police or Rural Constable on the order of the Warden.

  1.  

    29.   Every person who carries meat into any stall shall be cleanly dressed.

  1.  

    30.   No person except the holder, his or her seller or assistant shall be allowed in any meat stall without the permission of the Warden.

  1.  

    31.   No person shall chop any meat in the stalls except on blocks approved by the Warden.

  1.  

    32.   Nothing shall be kept or offered for sale in any stall except meat, without the permission of the Warden.

  1.  

    33.   The holder of every stall is liable for any offence committed in respect of such stall.

  1.  

    34.   The holding of any stall shall be for one month or for one day and the Warden may refuse to rent a stall to any person, and the allotting of stalls at the beginning of every month or any day shall be in the discretion of the Warden.

Sale of Fish and Turtle

  1.  

    35.   Fish means any kind of uncooked sea fish or turtle, and stale fish means any such fish found in the possession of any person after 9 p.m.

  1.  

    36.   No person shall dispose of fish on any day, other than the day upon which it has been taken from the sea, and “day” shall mean the time between 1 a.m. and 9 p.m. of any day.

  1.  

    37.   No person shall sell or offer or expose for sale any fish in any part of the Village or within one mile thereof except in such place as shall be appointed or approved by the Warden.

  1.  

    38.   No person shall sell rotten fish at any time or in any place.

  1.  

    39.   All stale fish except it be cleaned and salted or is being sold or offered for sale by permission of the Warden, after 9 p.m. is liable to be seized by the Warden or any Police Constable and destroyed, and every person in whose possession stale fish is found, without such permission commits an offence against these Rules.

Sale of Milk

  1.  

    40.   Any person who is found conveying or selling or offering for sale or who is proved to have sold milk in the Village or within one mile thereof which has in any way been adulterated with water or any foreign substance commits an offence against these Rules.

  1.  

    41.   All milk kept, offered or exposed for sale in the Village or within one mile thereof, may be tested by the Warden or any person authorised by him or her with a lactometer or by other sufficient means and any milk with a density less than 1051 shall be considered adulterated, and is liable to be seized and destroyed by order of the Warden, and the Warden or any person authorised by him or her shall have a right to go into any store, shop, dwelling house or other place or stop any person in any street, road, public or other place for the purpose of testing milk so kept, offered or exposed for sale.

  1.  

    42.   All milk being kept, conveyed or exposed for sale in the Village or within one mile thereof shall be kept or conveyed in clean vessels and be covered so as to prevent flies, insects or other foreign substance getting into the milk.

  1.  

    43.   Any person who shall wilfully throw, deposit or place any water or other foreign substance in any milk which is kept, or being conveyed or offered or exposed for sale in any place commits an offence against these Rules.

Sale of Charcoal

  1.  

    44.   All charcoal in bags or other original packages brought into the Village shall be deposited in the market or place appointed by the Warden, and any person who shall deposit such charcoal in any other place or who shall remove such charcoal therefrom without a licence first obtained for the disposal thereof commits an offence against these Rules.

  1.  

    45.   Any person who permits any charcoal in bags or other original packages to be deposited in his or her store, shop, house or on his or her land, or in whose possession such charcoal is found contrary to the provisions of the foregoing rule commits an offence against these Rules.

Miscellaneous Offences

  1.  

    46.   Every person who shall any of the following acts commits an offence against these Rules—

    1.  

      1.     Smoke in the market or bring or light any fire in the market.

    1.  

      2.     Sit, stand on, lie on any block, counter, table in the market.

    1.  

      3.     Do any damage to any part of the market.

    1.  

      4.     Use any obscene, abusive or insulting language, or swear or sing, or shout, or fight, or create any disorder, or do any obscene act in the market.

    1.  

      5.     Throw any dirt, filth, rubbish or litter in the market.

    1.  

      6.     Bring or allow any dog to follow him or her into the market, or to remain therein.

  1.  

    47.   Any poultry found trespassing in the market may be seized or killed by any person, and immediately sold by the Warden or any Police Constable and the proceeds paid into the Treasury to the credit of the Market Fund.

  1.  

    48.   No person affected with any loathsome or contagious disease, or with sores shall go into the market, and if found therein, shall leave immediately on being requested to do so by the Warden, any Police Constable, assistant or servant.

  1.  

    49.   Every person who shall refuse to obey the orders for the Warden whether issued by himself or herself or through a Police Constable, assistant or servant with respect to any rule commits an offence against these Rules.

  1.  

    50.   Every person who shall commit a breach of any of the rules hereinbefore defined or who shall obstruct, resist, molest or interfere with the Warden or any assistant or servant or Police Officer in the execution of their duties prescribed by any such rules, commits an offence and being convicted is liable to a penalty not exceeding $24 and in default of payment to imprisonment with or without hard labour for any term not exceeding one month.

Dues

  1.  

    51.   The dues set out in Schedule “C” shall be the dues payable under these Rules, and such Schedule, and also Schedules “A” and “B” may be altered, amended, added to or otherwise changed by Cabinet and any such change shall have effect from the publication thereof in the Gazette.

Forms and Procedure

  1.  

    52.   Market receipts, licences or any other document required to be issued under these Rules may be in such form as the Warden may prescribe from time to time.

  1.  

    53.   Every proceeding instituted under these Rules shall be in the name and at the instance of the Warden before the District Court and the procedure shall be the same as the procedure for the time being in force in respect of Summary Offences, provided that the Warden may authorise in writing any Police Officer in charge of a Police Station to appear and prosecute any charge made by him or her.

7.   Canaries

    50.   Every person who shall commit a breach of any of the rules hereinbefore defined or who shall obstruct, resist, molest or interfere with the Warden or any assistant or servant or Police Officer in the execution of their duties prescribed by any such rules, commits an offence and being convicted is liable to a penalty not exceeding $24 and in default of payment to imprisonment with or without hard labour for any term not exceeding one month.

Dues

  1.  

    51.   The dues set out in Schedule “C” shall be the dues payable under these Rules, and such Schedule, and also Schedules “A” and “B” may be altered, amended, added to or otherwise changed by Cabinet and any such change shall have effect from the publication thereof in the Gazette.

Forms and Procedure

  1.  

    52.   Market receipts, licences or any other document required to be issued under these Rules may be in such form as the Warden may prescribe from time to time.

  1.  

    53.   Every proceeding instituted under these Rules shall be in the name and at the instance of the Warden before the District Court and the procedure shall be the same as the procedure for the time being in force in respect of Summary Offences, provided that the Warden may authorise in writing any Police Officer in charge of a Police Station to appear and prosecute any charge made by him or her.

8.   Anse-la-Ray Slaughterhouse

The appointment of the Market, its Control and Management

  1.  

    1.   The Anse-la-Raye Slaughterhouse shall mean the slaughter house erected for the purpose and shall include the slaughter house, fish and other stalls and any place appointed by the Town Warden for slaughtering cattle, the sale of fish and charcoal and any land enclosed, set aside or appropriated for the use and purpose of the market.

  1.  

    2.   The slaughter house shall be under the supervision and control of the Town Warden, hereinafter referred to as the Warden, who may, subject to the approval of Cabinet, appoint such assistants and servants as may be necessary from time to time, and any assistant performing duties delegated to him or her in respect of the slaughter house, shall subject to the orders of the Warden have all the powers of the Warden.

  1.  

    3.   The Warden shall collect the dues prescribed in Schedule “C” and shall give receipts and market licences from the books furnished to him or her for every payment made to him or her and shall keep a strict account of all moneys received by him or her and shall pay the same into the Treasury at the close of each week, and shall be entitled to a commission of 5% on the moneys so collected and paid into the Treasury.

  1.  

    4.   The slaughterhouse shall subject as is hereinafter provided, be open to the public from 6a.m. to 6p.m. daily, except on Sundays, Bank-holidays and on all days which Cabinet may declare and appoint to be days of solemn fast or thanksgiving or public holidays when it shall be open from 6 to 9a.m. for the sale of such articles as are permitted to be sold by any law for the time being in force regulating trade on Sundays.

  1.  

    5.   The Warden may close the slaughterhouse on any day or for any time, and shall give directions for the sale of produce elsewhere as he or she may think fit.

Slaughter of Cattle

  1.  

    6.   Cattle shall unless the context otherwise requires mean the male and female and young of any kine, sheep, goat or swine, and animal shall include any cattle, and meat shall mean every part of any slaughtered cattle except the skin, horns, hoofs and shell.

  1.  

    7.   Slaughterer shall mean a person licensed by the Warden to slaughter animals at the slaughter house.

  1.  

    8.   Every person desiring to be licensed as a slaughterer in the Market shall make application in writing to the Warden and if the Warden is satisfied that he or she is a fit and proper person to be licensed shall issue a licence to him or her on the payment of the fee prescribed in the Schedule of Dues.

  1.  

    9.   The Warden may at any time cancel the licence of any slaughterer for any misconduct, disobedience of orders or breach of any Market Rules.

  1.  

    10.   No cattle shall be slaughtered in any part of the Village or within one mile thereof except at the slaughter house or such place appointed by the Warden, and by a slaughterer.

  1.  

    11.   A slaughterer shall not slaughter any cattle at the slaughter house unless the receipt issued by the Market Clerk for the dues payable in respect to the animal to be slaughtered is handed to him or her, which receipt he or she shall keep as his or her authority.

  1.  

    12.   Any cattle intended for slaughter must be exhibited to the Market Clerk, and if the Market Clerk is satisfied that the animal is fit for food and is not in young he or she shall collect the slaughter house dues and issue a receipt for each animal.

  1.  

    13.   Any cattle which in the opinion of the Market Clerk is unfit for food shall be sold or offered for sale until the same has been examined by a Medical Officer and a certificate of soundness produced.

  1.  

    14.   No meat which is in the opinion of the Market Clerk unfit for food shall be sold or offered for sale until the same has been examined by a Medical Officer and a certificate of soundness produced.

  1.  

    15.   The Medical Officer will be entitled to a fee according to the Schedule to be paid in the first instance by the owner of the suspected animal which fee will be refunded by the Market Clerk immediately on a certificate of soundness being produced to him or her unless the Medical Officer certifies that there was good reason for suspecting a diseased condition.

Miscellaneous Offences

  1.  

    16.   Every person who shall any of the following acts commits an offence against these Rules—

    1.  

      1.     Smoke in the market or bring or light any fire in the market.

    1.  

      2.     Sit, stand on, lie on any block, counter, table in the market.

    1.  

      3.     Do any damage to any part of the market.

    1.  

      4.     Use any obscene, abusive or insulting language, or swear or sing, or shout, or fight, or create any disorder, or do any obscene act in the market.

    1.  

      5.     Throw any dirt, filth, rubbish or litter in the market.

    1.  

      6.     Bring or allow any dog to follow him or her into the market, or to remain therein.

  1.  

    17.   Any poultry found trespassing in the market may be seized or killed by any person, and immediately sold by the Warden or any Police Constable and the proceeds paid into the Treasury to the credit of the Market Fund.

  1.  

    18.   No person affected with any loathsome or contagious disease, or with sores shall go into the market, and if found therein, shall leave immediately on being requested to do so by the Warden, any Police Constable, assistant or servant.

  1.  

    19.   Every person who shall refuse to obey the orders for the Warden whether issued by himself or herself or through a Police Constable, assistant or servant with respect to any rule commits an offence against these Rules.

  1.

9.   Anse-la-Raye Fish Market
  1.  

    1.   Citation

These By-laws may be cited as the Anse-la-Raye (Fish Market) By-laws.

  1.  

    2.   Interpretation

In these By-laws the following expressions have the meanings respectively assigned to them, that it is to say—

clerk” means the clerk of the Village Council and includes his or her assistant;

day” means the period of time between 1 a.m. and 9 p.m. of any day;

dispose of” means sell, barter, offer or expose for sale or barter or cause to be sold, bartered or offered or exposed for sale or barter;

fish” means any kind of uncooked sea fish or turtle;

fish market” means the building (including the stalls or stands therein) erected by the Village Council at Anse-la-Raye for the purpose of the sale of fish, or any other place appointed by the Village Council for the aforesaid purpose;

stale fish” means any fish found in the possession of any person for disposal after 9 p.m.;

village” means the village of Anse-la-Raye;

Village Council” means the Village Council of Anse-la-Raye.

  1.  

    3.   Control of fish

  1.  

    The Fish Market shall be under the supervision and control of the Village Council. The Clerk or any servant from time to time authorised by the Council shall exercise the powers of the Village Council in respect of the market.

    4.   Duties of clerk

The Clerk shall collect all dues that may from time to time be prescribed, and shall give receipts and market licences from the books that may be furnished to him or her. He or she shall keep a strict account of all moneys received by him or her, and shall pay the same into the Sub-collector's Office at least weekly.

    5.   Opening and closing hours of market

The Fish Market shall be open to the public from 6 a.m. to 6 p.m. daily except on Sundays, Bank-holidays and days proclaimed to be public holidays when it shall be open from 6 a.m. to 9 a.m.

    6.   Power to close market

The Clerk may close the Fish Market on any day for any time and shall give directions for the sale of fish elsewhere as the Council may think fit.

    7.   Blocks to be approved by clerk

No person shall chop any meat, fish or turtle, except on blocks approved by the Clerk.

    8.   Time within which fish may be disposed of

No person shall dispose of fish on any day other than the day upon which it has been taken from the sea.

    9.   Place of disposal of fish

No person shall dispose of any fish in any part of the Village or within one mile thereof except at the Fish Market or such other place as shall be appointed by the Village Council for the purpose and on payment of the appropriate fee set out in the Schedule.

  1.  

    10.   Flying fish

  1.  

    (1)   Flying fish may be sold on the beach near the Fish Market by virtue of a licence and upon payment of the fee specified in the Schedule for such licence which shall only be valid for the day of issue and in respect of the canoe for which it is issued.

  1.  

    (2)   Notwithstanding any provision of these By-laws to the contrary, flying fish may be sold up to 10 p.m. on any day.

  1.  

    (3)   Each licence shall be issued in respect of one canoe only and shall contain the number, or other description sufficient to identify the canoe for which it is issued.

  1.  

    (4)   Any person found selling flying fish from a canoe, boat, ship or vessel and who fails to produce a licence complying with paragraphs (1) and (3) of this By-law when required to do so by the Clerk, or by any Police Officer or Constable commits an offence against these By-laws.

  1.  

    11.   Hawkers

Hawkers desirous of selling fish shall obtain a daily ticket and shall pay the sum prescribed in the Schedule.

  1.  

    12.   sale of rotten fish prohibited

No person shall sell rotten fish at any time or in any place. Any rotten fish found in the possession of any person shall be seized by the Clerk, or any Police Constable.

  1.  

    13.   Provisions as to sale of stale fish

All stale fish except it be cleaned and salted, or is being sold or offered for sale by permission of the Clerk after 9 p.m. shall be liable to be seized by the Clerk or any Police Constable and destroyed, and every person in whose possession stale fish is found without such permission commits an offence against these By-laws.

  1.  

    14.   Duty to clean stalls

Every person who uses the Fish Market or any stall or stand therein shall at the end of the day clean the spot or stall used by him or her, and deposit all offal or refuse in the receptacle provided for the purpose.

  1.  

    15.   Power of Village Council to prohibit use of stall

The Village Council may refuse to allow any person who has been twice convicted of any offence under these By-laws to use any stall or stand in the market for such time as it may think proper.

  1.  

    16.   Allotment of stalls

No stall or stand shall be allotted to more than one person at the same time.

  1.  

    17.   Persons who may use stalls

No person shall be allowed in any stall without the permission of the Clerk except the holder, his or her seller and an assistant.

  1.  

    18.   Stall holders liable for offences against stall

The holder of any stall or stand is liable for any offence committed by him or her, his or her agent, seller or other person under his or her control in respect of such stall or stand.

  1.  

    19.   Duty of stall holder in relation to produce in his or her stall

No holder of a stand ticket shall allow any produce not being his or her bona fide property to be placed thereon for sale or otherwise; and shall not allow his or her produce to extend beyond the limits of his or her stand.

    20.   Production of market ticket

Every seller at a stand shall produce his or her market ticket when required to do so by the Clerk.

    21.   Diseased persons

    5.   Opening and closing hours of market

The Fish Market shall be open to the public from 6 a.m. to 6 p.m. daily except on Sundays, Bank-holidays and days proclaimed to be public holidays when it shall be open from 6 a.m. to 9 a.m.

    6.   Power to close market

The Clerk may close the Fish Market on any day or for any time and shall give directions for the sale of fish elsewhere as the Council may think fit.

    7.   Blocks to be approved by clerk

No person shall chop any meat, fish or turtle, except on blocks approved by the Clerk.

  1.  

    8.   Time within which fish may be disposed of

No person shall dispose of fish on any day other than the day upon which it has been taken from the sea.

  1.  

    9.   Place of disposal of fish

No person shall dispose of any fish in any part of the Village or within one mile thereof except at the Fish Market or such other place as shall be appointed by the Village Council for the purpose and on payment of the appropriate fee set out in the Schedule.

  1.  

    10.   Flying fish

  1.  

    (1)   Flying fish may be sold on the beach near the Fish Market by virtue of a licence and upon payment of the fee specified in the Schedule for such licence which shall only be valid for the day of issue and in respect of the canoe for which it is issued.

  1.  

    (2)   Notwithstanding any provision of these By-laws to the contrary, flying fish may be sold up to 10 p.m. on any day.

  1.  

    (3)   Each licence shall be issued in respect of one canoe only, and shall contain the number, or other description sufficient to identify the canoe for which it is issued.

  1.  

    (4)   Any person found selling flying fish from a canoe, boat, ship or vessel and who fails to produce a licence complying with paragraphs (1) and (3) of this By-law when required to do so by the Clerk, or by any Police Officer or Constable commits an offence against these By-laws.

    11.   Hawkers

Hawkers desirous of selling fish shall obtain a daily ticket and shall pay the sum prescribed in the Schedule.

    12.   Sale of rotten fish prohibited

No person shall sell rotten fish at any time or in any place. Any rotten fish found in the possession of any person shall be seized by the Clerk, or any Police Constable.

    13.   Provisions as to sale of stale fish

All stale fish except it be cleaned and salted, or is being sold or offered for sale by permission of the Clerk after 9 p.m. shall be liable to be seized by the Clerk or any Police Constable and destroyed, and every person in whose possession stale fish is found without such permission commits an offence against these By-laws.

    14.   Duty to clean stalls

Every person who uses the Fish Market or any stall or stand therein shall at the end of the day clean the spot or stall used by him or her, and deposit all offal or refuse in the receptacle provided for the purpose.

    15.   Power of village council to prohibit use of stall

The Village Council may refuse to allow any person who has been twice convicted of any offence under these By-laws to use any stall or stand in the market for such time as it may think proper.

  1.  

    16.   Allotment of stalls

No stall or stand shall be allotted to more than one person at the same time.

  1.  

    17.   Persons who may use stalls

No person shall be allowed in any stall without the permission of the Clerk except the holder, his or her seller and an assistant.

  1.  

    18.   Stall holders liable for offences against stall

The holder of any stall or stand is liable for any offence committed by him or her, his or her agent, seller or other person under his or her control in respect of such stall or stand.

  1.  

    19.   Duty of stall holder in relation to produce in his or her stall

No holder of a stand ticket shall allow any produce not being his or her bona fide property to be placed thereon for sale or otherwise; and shall not allow his or her produce to extend beyond the limits of his or her stand.

  1.  

    20.   Production of market ticket

Every seller at a stand shall produce his or her market ticket when required to do so by the Clerk.

  1.  

    21.   Diseased persons

No person affected with any loathsome or contagious disease, or with sores shall go into the Fish Market, and if found therein shall leave immediately on being requested to do so by the Clerk, any other servant of the Village Council or any Police Constable.

  1.  

    22.   Refusal to obey orders of clerk

Every person who shall refuse to obey the orders of the Clerk whether issued by himself or herself, any other servant of the Village Council or a Police Constable with respect to any By-law commits an offence against these By-laws.

  1.  

    23.   Miscellaneous offences

Every person who shall do any of the following acts commits an offence against these By-laws:

  1.  

    1.     Smoke in the market or bring or light any fire in the market.

  1.  

    2.     Sit, stand on, lie on any block, counter, table in the market.

  1.  

    3.     Do any damage to any part of the market.

  1.  

    4.     Use any obscene, abusive or insulting language, or swear or sing, or shout, or fight, or create any disorder, or do any obscene act in the market.

  1.  

    5.     Throw any dirt, filth, rubbish or litter in the market.

  1.  

    6.     Bring or allow any dog to follow him or her into the market, or to remain therein.

  1.  

    24.   Breaches of by-laws

Every person who shall commit a breach of any of these By-laws hereinbefore defined or who shall obstruct, resist, or interfere with the Clerk or his or her assistant or any servant of the Village Council or Police Officer in the execution of their duties prescribed in these By-laws, commits an offence and being convicted is liable to a penalty not exceeding $25 and in default of payment to imprisonment with or without hard labour for any term not exceeding one month.

    25.   Fees

The sums payable for the rental of stalls, licences and other dues imposed by these By-laws shall be as set out in the Schedule.

PART 3
BOUNDARIES OF THE TOWNS AND VILLAGES
  1.  

    1.   The respective limits and boundaries of the undermentioned Towns and Villages shall for all purposes be as follows:

    1.  

      (a)     Soufriere: Towards the North, by the Soufriere River, towards the South, by the Malgretoute Canal and Trou Vaillant Ravine, towards the East, by the Soufriere Estate and the Roman Catholic Vestry Lands, or as the same are more particularly delineated and described in the plan of the boundaries of the said Town of Soufriere made by Rupert Augustus McNamara, Assistant Staff Surveyor, on 9 July 1919, and lodged in the Registry Office, Castries on 16 July 1919.

      (b)     Vieux-Fort: To the North by the American Base, to the South by the Sea, to the East by the American Base and to the West by the Vieux-Fort River.

      (c)     Choiseul: To the North by the lands of the Reunion Estate, to the South by the Choiseul River and the highway from Soufriere to Choiseul, to the East by the Reunion Estate, and to the West by the lands of the Reunion Estate and by the sea, according to a plan prepared by the Commissioner of Crown Lands from a survey executed by John Edward Quinlan, Land Surveyor, on 19 August 1891, and a survey executed by Salvador Montes de Oca, Land Surveyor, between 8 May and 18 June 1913.

      (d)     Dennery: Towards the North by lands of the Anse Canot Estate, towards the North-East by the main Road from Castries to the said Village of Dennery, towards the North-West by lands of the Anse Canot Estate, and the Roman Catholic Vestry, towards the South by the Dennery River, and towards the South-East and South-West by the Sea, or as the same are more particularly delineated and described in the plan of the boundaries of the said Village of Dennery made by Ralph Templeton Galt, Land Surveyor, on 25, 25, 26 and 27 November 1909.

      (e)     Micoud: Toward the North by the Sea, towards the South by lands of the Saint Lucia Usines and Estates Company (1907) Limited, towards the East by the Sea, towards the West by lands of the said Company, and by lands of the Jean Baptiste Estate, and towards the South-West by lands of the said Company, or as the same are more particularly delineated and described in the plan of the boundaries of the said Village of Micoud made by Salvador Montes de Oca, Staff Surveyor, on 6 May 1912.

      (f)     Canaries: Towards the North, by the Sea, towards the South, by the Canaries Estate, towards the East, by the said Canaries Estate, towards the West, by the Canaries River, or as the same are more particularly delineated and described in the plan of the boundaries of the said Village of Canaries made by Rupert Augustus McNamara, Assistant Staff Surveyor, on 31 December 1919, and lodged in the Registry Office, Castries, on 3 January 1920.

      (g)     Anse-la-Raye: To the North by the Lagoon and Petite Riviere de L'Anse-la-Raye, to the South by the Grande Riviere de L'Anse-la-Raye, to the East by the Estates known on the Plan of Saint Lucia as Lefort de latour Freres, No. 2 Black, and Heirs Riviere No. 44 Black, and on the West by the Sea, according to Plans and Reports respectively of John Edward Quinlan, Sworn Land Surveyor, dated 13 October 1890, and of Adrien Monplaisir, Sworn Land Surveyor, dated 19 May 1899.

      (h)     Gros-Islet: To the North and South by the Lagoon, to the East by a Canal passing to the East of the Presbytery and the swamp, and to the West by the Sea, according to a Plan and Report of Survey made by John Edward Quinlan, Sworn Land Surveyor, dated 14 September 1889.

      (i)     Laborie: Commencing at a point along the Laborie to Choiseul High Road, thence running in a South easterly direction across the lands of Mde. Stella Austini and Mde. Romiel Elizee to the Sea, thence running in a South easterly direction along the Sea to theh most Westerly point of a line across the lands of Mrs. Anne Raymond, thence running in a North easterly direction across the lands of Mrs. Anne Raymond, Mrs. Theophile Arlette, Mde. Mathile Augustin, Edward Francois, Perinon Chambord, Mde. Annius Andrew, Mde. Emmanuel Alphonse, Mde. Felicien Titouu, Elius Auguste, Nicholas Canchon to the most easterly point situate on the lands of the said Nicholas Canchon, thence running in a North westerly direction across the Laborie to Vieux-Fort High Road to a point on the lands of Mde. Alfred Soupran, thence running in a westerly and South westerly direction across the lands of Mde. Alfred Soupran, Headly Polius, Dieudonne St. Helene, Saul Direx, Heirs of Arthur Medard, Roman Catholic Parish of Laborie, Seraphin Cherubin, Valentine Ernest, Morris Langellier and across the Laborie to Choiseul High Road to the point of commencement aforesaid according to a Plan and Report of Survey made by Wilfred John Rodrigues, Sworn Land Surveyor, dated Wednesday 10 May 1950, and lodged in the office of the Commissioner of Crown Lands on 19 June 1950.
