12.   Qualifications of members of local authority

  1.  

    (1)   No person shall be qualified to be elected as a member of a local authority unless he or she—

    1.  

      (a)     is a British subject;

    1.  

      (b)     has attained the age of 21 years;

    1.  

      (c)     can read and write the English language;

    1.  

      (d)     is not a person of unsound mind so found by any law in force in Saint Lucia; and

    1.  

      (e)     either—

      1.  

        (i)     is the proprietor or occupier of land or of a house and land in the urban village or rural district of an assessed annual rental value of not less than $28.80 as recorded in the assessment list of the district, or

      1.  

        (ii)     being resident in the urban, village or rural district is in receipt of a clear annual income of not less than $144, or

      1.  

        (iii)     being resident in the urban, village or rural district has paid direct taxes for the previous year to any amount whatsoever.

    (2)   For the purposes of the foregoing subsection the expression “direct taxes” shall include Income Tax payable in respect of income taxable in Saint Lucia under any law for the time being in force and any tax leviable on property situate within the boundaries of the urban, village or rural district but no other taxes whatever.
