9.   Persons under 16 year's of age

  1.  

    (1)   A Produce Seller's Licence shall not be issued to any person who, in the opinion of the magistrate, is under the age of 16 years.

  1.  

    (2)   A licence may be issued on his or her behalf to the guardian of such person under the age of 16 years, in which case—

    1.  

      (a)     the name of the guardian shall be entered on the licence in addition to that of the person under the age of 16 years;

    1.  

      (b)     all dealings in licensable produce under such licence shall be conducted by such guardian;

    1.  

      (c)     such guardian is liable in respect of any offence committed against the provisions of this Act in connection with such licence as if he or she were the licensee.
