41.   Power to inspect licence and search premises of produce dealer

  1.  

    (1)   The Director of Finance and Planning or any person authorised by him or her or by any magistrate, any police officer or a Produce inspector may enter the licensed premises of any licensed dealer or any house or building part of or contiguous thereto in the occupation of such dealer and—

    1.  

      (a)     call for and inspect such dealer's licence;

    1.  

      (b)     call for and inspect any book required to be kept under this Act;

    1.  

      (c)     take a copy of any entry in such book;

    1.  

      (d)     examine the licensable produce in the possession of such dealer and the place where it is stored;

    1.  

      (e)     weigh and compare all such licensable produce as may be in stock with the entries in such book.

  1.  

    (2)   Any licensed dealer who—

    1.  

      (a)     obstructs or resists any such entry;

    1.  

      (b)     fails or neglects to produce any such licence or book;

    1.  

      (c)     refuses to allow a copy of any entry in such book to be taken;

    1.  

      (d)     obstructs or resists the taking of any such copy; or

    1.  

      (e)     fails or neglects to give and provide such assistance as may be necessary for the purpose of checking the licensable produce in his or her possession,

  1.  

    commits an offence against this Act.
