19.   Seller to weigh or measure article if required

  1.  

    (1)   Every person who in any shop, warehouse, store, market or public place sells any goods by weight or measure, whether on his or her own behalf or on behalf of the owner of such goods, shall on demand made by the person to whom the goods are to be delivered—

    1.  

      (a)     if the goods are sold by weight, weigh the goods in a weighing instrument, in the presence of that person;

    1.  

      (b)     if the goods are sold by volume or capacity, measure the article in a measure of volume or capacity, in the presence of that person; or

    1.  

      (c)     if the article is sold by linear measure, measure the article using a measure of length, in the presence of that person.

    (2)   Subsection (1) shall not apply to the sale of pre-packaged goods.
