36.   Amendment of application

  1.  

    (1)   The Court hearing an application under section 33 may, before making a final declaration, and on the application of the Attorney General, amend the application to include any other land, as the case may be, on being satisfied that —

    1.  

      (a)     the land was not reasonably capable of identification when the application was originally made; or

    1.  

      (b)     necessary evidence became available only after the application was originally made.

    (2)   Where the Attorney General applies to amend an application for a forfeiture declaration and the amendment would have the effect of including additional land in the application for the forfeiture declaration he or she must give no less than 14 days written notice of the application to amend to a person who he or she has reason to believe may have an interest in the land to be included in the application for the forfeiture declaration.

    (3)   A person who claims an interest in the land to be included in the application for the forfeiture declaration may appear and adduce evidence at the hearing of the application to amend.
