23.   Restrictions on activities of unqualified persons at childbirth

From and after the date stated in any order published under section 22, and within the area in such order defined and delimited, any person who does not hold a valid and subsisting licence as a midwife who assists a woman in childbirth otherwise than under the direction and personal supervision of a registered medical practitioner or of a registered midwife commits an offence and is liable on summary conviction to a fine not exceeding $50 or to imprisonment for a term not exceeding 3 months or to both such fine and such imprisonment.

However, it is not an offence for a person to render assistance without fee or reward in a case of sudden or urgent necessity where no medical practitioner or midwife is available.
