18.   Cancellation or suspension of registration

  1.  

    (1)   The Council may by a 2/3 majority of its members present at a duly convened general meeting, suspend for such period as the Council shall think fit, or cancel the registration of any person whose name is registered under this Part and in such case the licence issued under section 17(1) is considered to be suspended or cancelled as the case may be.

    (2)   Suspension or cancellation of registration may be made upon proof to the satisfaction of the Council of—

    1.  

      (a)     professional dishonesty;

    1.  

      (b)     negligence or incompetence in the performance of duty;

    1.  

      (c)     a habit or illness rendering the midwife unfit to practise midwifery;

    1.  

      (d)     conduct that does not conform to the generally recognised standards of the profession of midwifery, or that is unbecoming to a midwife; or

    1.  

      (e)     fraud or misrepresentation in obtaining a registration, whether for herself or any other person, on the part of the person registered,

on the part of the person registered. (Amended by Act 16 of 1967)

    (3)   Proceedings shall not be taken for the suspension or cancellation of a registration unless at least 14 days' notice in writing has been given to the person concerned of the intention to take such proceedings, and of the grounds on which such proceedings are based, and such person shall be entitled to be heard in her defence and to be represented by counsel or solicitor at every stage of the proceedings.
