11.   Qualifications for admission to the Register of Nurses

    (1)   The names of all persons who are registered under the Medical Registration Act and of all persons who are permitted to practise in Saint Lucia as nurse immediately prior to the commencement of this Act shall be entered on the Register of Nurses established under this Part of this Act without need for application on the part of such persons; and pending the entry of their names on the Register of Nurses, all such persons are considered to be duly registered under this Act.

    (2)   A person who has completed a course of training in a recognised place of training and has passed the examinations prescribed by the Council and who establishes to its satisfaction that he or she is a fit and proper person to be entered on the Register of Nurses as a nurse, on making application to the Council and upon compliance with the requirements of this Act, is entitled to be registered.

    (3)   A person who establishes to the satisfaction of the Council that he or she is registered or registrable on the Register of the General Nursing Council of England and Wales and that he or she is a fit and proper person to be entered on the Register of Nurses as a nurse, is entitled, on making application in the prescribed manner and paying such fee as the Council may demand, to be registered in a corresponding manner under this Act.

    (4)   A person not entitled to be registered in accordance with subsections (1), (2) and (3) who establishes to the satisfaction of the Council that he or she is a graduate in nursing from a school that is recognised by the Council as providing a standard of training and examination not lower than that prescribed under this Act, and is registered and in good standing in the country, territory, state or province in which he or she graduated as a nurse, or in which he or she last practised as a nurse, and that he or she is a fit and proper person to be entered on the Register of Nurses shall, on making application to the Council and upon compliance with the requirements of this Act be entitled to be registered.

However, the Council as a condition of registration may require that such person submit to and pass an examination prescribed by the Council.

    (5)   When there is a reciprocal agreement concerning nurses between this Island and any part of the British Commonwealth or any foreign country, any person who establishes to the satisfaction of the Council that he or she is registered in such part of the British Commonwealth or foreign country generally as a nurse for the sick shall be entitled on making an application to the Council and paying such fee, not being greater than the fee payable on ordinary applications for registration as a nurse under this Act, as the Council may demand, to be registered in the corresponding manner under this Act.

    (6)   Where the Council is satisfied that a person although not qualified to be registered as a nurse under the provisions of this Act, has undergone such a degree of training as in the opinion of the Council renders such a course expedient, the Council may upon the application of such person, direct that such person be exempted from such portion of the prescribed course of training or from such portion of the examination as to the Council shall seem fit, or that such person shall be registered upon compliance with such conditions as to training and to the passing of examinations as the Council shall think fit.
