25.   Medical witness

  1.  

    (1)   If, on holding an inquest, the coroner finds that the deceased person was attended by a medical practitioner during his or her last illness, the coroner may issue an order for the attendance of that medical practitioner as a witness at the inquest and that medical practitioner shall, unless unavoidably prevented from so doing, attend as a witness at the inquest.

    (2)   The coroner may accept a medical report signed by the medical practitioner summoned under subsection (1), instead of his or her testimony.

    (3)   A medical report accepted under subsection (2) is, without further proof, evidence at that inquest, unless—

    1.  

      (a)     the jury; or

    1.  

      (b)     an interested person having sufficient reason to do so,

    wishes to examine the medical practitioner in which case the coroner may require the medical practitioner to attend and give evidence at the inquest.
