24.   Witness summons

  1.  

    (1)   A coroner may issue summons to any person who, in the opinion of the coroner, might be able to give material evidence on the matters to be inquired into at the inquest.

    (2)   A summons to appear as a witness may be served by the proper officer at least 7 days before the day appointed for the inquest on the person summoned by personal service or by leaving it for the person at his or her last usual place of abode or by leaving it at his or her place of employment or business.

    (3)   A coroner has the same powers to compel the attendance of witnesses and to punish a witness for disobeying a summons to appear, refusing to be sworn or refusing without lawful excuse to give evidence as are conferred on a magistrate under the Criminal Code.

    (4)   The jury may ask questions of each witness.
