26.   Prohibition of burial of body without warrant

  1.  

    (1)   A person shall not, without lawful excuse and without a coroner's warrant, bury or cause to be buried the deceased body of a deceased person in respect to whose death an investigation or inquest ought to be held under this Act.

    (2)   A person who contravenes subsection (1) commits an offence and is liable on summary conviction to a fine of not less than $1,000 or a term of imprisonment of not less than 3 months or both.

    (3)   Where any person is charged with an offence under this section, the onus of proving that he or she has a lawful excuse or that he or she had the coroner's warrant, is on him or her.
