(1) Subject to subsection (2), a service licensee who fails to comply with a direction given by the Commission under section 87 commits an offence and upon conviction on indictment is liable to a fine not exceeding $100,000 or to imprisonment for a term not exceeding 15 years or to both. (2) A prosecution for an offence pursuant to subsection (1) shall not be brought during the time within which an appeal may be applied for or during an appeal pursuant to section 96.
