46.   Liability of parent

  1.  

    (1)   A parent of a child of compulsory school age, who neglects or refuses to cause the child to attend school, unless the child is excused under section 38, commits an offence and is liable on summary conviction to a fine not exceeding $1,000.

    (2)   The court may, instead of imposing a fine, require a person convicted of an offence under subsection (1) to enter into a bond not exceeding $1,000, with one or more sureties to be approved by the court, on condition that the person shall, after the expiration of 5 days, cause the child to attend school as required.
