8.   Delegation of authority by Minister

  1.  

    (1)   The Minister may delegate in writing to the Chief Education Officer any function, duty or responsibility conferred on the Minister by this Act or any regulation made under this Act, but this does not preclude the Minister from exercising any or all of the functions so delegated where the Minister considers it expedient.

    (2)   After consultation with the Permanent Secretary and the Chief Education Officer, the Minister may give general or special directions in writing to any public officer in the Ministry respecting the Minister's functions under this Act and the public officer shall carry out the Minister's directions.

    (3)   Where under this Act or any enactment made under this Act the Chief Education Officer is required or permitted or otherwise to perform any function, the Chief Education Officer may, after consulting the Permanent Secretary, authorise a public officer who is accountable to him or her to perform the function.
