Schedule 1

(Section 9(6))

EDUCATION ADVISORY BOARD

1.   Definition

In this Schedule, “Board” means the Education Advisory Board appointed under section 9.

2.   Tenure

The appointment of a member of the Board is, subject to this Schedule, for a period not exceeding 2 years, but the member is eligible for re-appointment.

3.   Chairperson and Deputy Chairperson

The Board shall elect a chairperson and a deputy chairperson from among its members.

4.   Temporary appointment

In the absence or in the case of the inability to act of a member, the Minister may appoint any person from the group that member represents to act temporarily in place of such member.

5.   Resignation of members

    (1)   Any member of the Board, other than the chairperson may at any time resign from the Board by instrument in writing addressed to the Minister and transmitted through the chairperson and from the date of the receipt by the Minister of such instrument such member shall cease to be a member of the Board.

    (2)   The chairperson may at any time resign his or her office as a member of the Board by instrument in writing addressed to the Minister and such resignation shall take effect from the date of the receipt of such instrument by the Minister.

6.   Forfeiture of membership

Any member of the Board who fails to attend 3 consecutive meetings without excuse acceptable to the Board shall cease to be a member.

7.   Filling of vacancies

If any vacancy occurs in the membership of the Board such vacancy shall be filled by the appointment of another member who may, subject to this Schedule hold office for the remainder of the period for which the previous member was appointed, but such appointment shall be made in the same manner and from the same category of persons, if any, as the appointment of the previous member.

8.   Publication of membership

The names of all members of the Board as first constituted and every change in the membership shall be published in the Gazette.

9.   Constitution not affected by vacancy

The Board is considered to be properly constituted for the purpose of this Schedule despite any vacancy among its members or any defect in their appointments.

10.   Meetings

    (1)   The Board shall meet at least 3 times a year and at such other times as may be convenient or expedient for the transaction of business and at such places as the chairperson may determine.

    (2)   Subject to this Schedule, the Board may regulate its own procedure.

11.   Special meetings

The chairperson may at any time call a special meeting of the Board and shall call a special meeting within 14 days of a requisition for that purpose addressed to him or her by any 5 members.

12.   Person to preside at meetings

The chairperson or, in his or her absence, the deputy chairperson shall preside at the meetings of the Board, and in case of the absence of both the chairperson and the deputy chairperson, the members present and constituting a quorum shall elect a temporary chairperson from among the members present.

13.   Voting

The decisions of the Board shall be by a majority of votes of the members present and, in addition to an original vote, the chairperson or any other person presiding at the meeting shall have a casting vote in any case in which the voting is equal.

14.   Quorom

The quorum of the Board at any meeting shall be 6.

15.   Minutes

Minutes of the proceedings of the Board shall be kept in proper form.
