8.   Penalty for neglecting to take out a licence

    (1)   Every person liable to take out a licence under this Act neglecting to do so in the manner prescribed by this Act, where no other penalty is herein provided, is liable on summary conviction to a penalty not exceeding $24, and in default of payment to be imprisoned, with or without hard labour, for a period not exceeding 2 months, and where at the time of conviction he or she has not taken out the required licence he or she is liable to pay in addition to such penalty a sum equal to the amount of the fee payable for the licence so neglected to be taken out; and payment of such additional sum may be enforced in like manner as the payment of such penalty.

    (2)   Where upon any conviction under this section the said additional sum has been adjudged to be paid and has been paid by the defendant, the person receiving the same shall as soon as practicable thereafter pay the same to the Director of Finance and Planning or to the revenue officer in charge of the nearest revenue office and thereupon the defendant shall be entitled to be given by the Director of Finance and Planning or such revenue officer, without further payment, the licence in respect of which such additional sum was adjudged to be paid.
