(1) Every offence against this Act or any rules made hereunder shall be heard and determined by a magistrate as an offence punishable on summary conviction, and the mode of procedure shall be according to the provisions of any law regulating the procedure before magistrates.
(2) Proceedings in respect of any such offence shall be taken by and in the name of the Director of Finance and Planning, the Commissioner of Police, the police officer or non-commissioned officer in charge of a police station or any person thereto authorised in writing by the Governor General, Director of Finance and Planning or Commissioner of Police.
