(1) The Minister upon application being made to him or her by an association of agricultural producers and, on being satisfied that—
(a) its constitution is such as to ensure that all its members have the right to participate directly or indirectly in the election or appointment of its governing body; and
(b) the association has as its principal object the furtherance of the interests of its members,
may by notice published in the Gazette declare such association to be an “approved association” for the purposes of this Act.
(2) Where an approved association has a majority of its members who are producers of any specified produce the Minister may, by notice published in the Gazette, declare such approved association to be a “nominating body”, and such association shall thereupon be entitled to submit the names of persons recommended by them for appointment as members.
(3) The Minister may decline to accept any such recommendation without assigning a reason for so doing.
