46.   Presumptions as to subsistence and ownership of copyright

In an action brought by virtue of this Part—

  1.  

    (a)     copyright shall be presumed to subsist in the work to which the action relates if the defendant does not put in issue the question whether copyright subsists therein;

  1.  

    (b)     where the subsistence of the copyright is proved or admitted or is presumed under paragraph (a), the plaintiff shall be presumed to be the owner of the copyright, if he or she claims to be the owner of the copyright and the defendant does not put in issue the question of his or her ownership thereof; and

  1.  

    (c)     if the question arises whether an article is an infringing copy of a work and it is shown—

    1.  

      (i)     that the article is a copy of the work, and

    1.  

      (ii)     that copyright subsists in the work or has subsisted at any time,

  1.  

    it shall be presumed until the contrary is proved that the article was made at a time when copyright subsisted in the work.
