717.   Rectification of registers by court

  1.  

    (1)   The Court may, on the application in the prescribed manner of any person aggrieved by the non-insertion in or omission from the Register of Patents, Designs and Trade Marks, of any entry, or by any entry made in either such register without sufficient cause, or by an entry wrongly remaining in either such register, or by an error or defect in any entry in either such register, make such order for making, expunging, or varying such entry as it may think fit.

    (2)   The Court may in any proceedings under this article decide any question that it may be necessary or expedient to decide in connection with the rectification of a register.

    (3)   In case of fraud in the registration or transmission of a registered trade mark, the Registrar may himself or herself apply to the Court under the provisions of this article.

    (4)   Any order of the Court rectifying the register shall direct that notice of the rectification shall be served upon the Registrar in the prescribed manner, who shall upon receipt of such notice rectify the register accordingly.
