653.   Revocation of patent

  1.  

    (1)   Revocation of a patent may be obtained on petition to the Court on any of the following grounds—

    1.  

      (a)      that the patent was obtained by fraud;

    1.  

      (b)      that the patentee was not the true inventor or proprietor of every invention included in his or her claim; or

    1.  

      (c)      that anything claimed by the patentee as his or her invention was publicly manufactured, used or sold within Saint Lucia, before the date of the patent, or included in some prior patent.

  1.  

    (2)   A petition for revocation of a patent may be presented—

    1.  

      (a)     by the Crown Attorney or any person authorised by him or her; or

    1.  

      (b)     by any person alleging—

      1.  

        (i)     that the patent was obtained in fraud of his or her rights, or of the rights of any person under or through whom he or she claims, or

      1.  

        (ii)     that he or she, or any person under or through whom he or she claims, was the true inventor of any invention included in the claim of the patentee, or

      1.  

        (iii)     that he or she, or any person under or through whom he or she claims an interest in any trade, business or manufacture, had publicly manufactured, used, or sold, within Saint Lucia, before the date of the patent, anything claimed by the patentee as his or her invention.
