CHAPTER 2
TERM OF PATENT

644.   Term of patent

  1.  

    (1)   The term limited in every patent for the duration shall, save as otherwise herein expressly provided, be 14 years from its date.

    (2)   A patent shall, notwithstanding anything therein or in this Title, cease if the patentee fails to pay the prescribed fees within the prescribed times; provided that the Registrar, upon the application of the patentee, shall, on receipt of such additional fee, not exceeding $48, as may be prescribed, enlarge the time to such an extent as may be applied for but not exceeding 3 months.

    (3)   If any proceeding is taken in respect of an infringement of the patent committed after a failure to pay any fee within the prescribed time, and before any enlargement thereof, the Court before which the proceeding is proposed to be taken may, if it thinks fit, refuse to award any damages in respect of such infringement.
