REALISATION OF PROPERTY

580.   Possession of property by trustee

  1.  

    (1)   The trustee shall, as soon as may be, take possession of the deeds, books and documents of the bankrupt, and all other parts of his or her property capable of manual delivery.

    (2)   For the purpose of acquiring or retaining possession of the bankrupt's property, he or she shall be in the same position as if he or she were a receiver or sequestrator appointed by the Court, and his or her demands may be similarly enforced.

    (3)   Every banker, attorney, or agent of the bankrupt shall disclose and deliver to the trustee all money and securities in his or her possession which he or she is not be law entitled to retain, upon pain of being adjudged guilty of contempt of Court.
