CHAPTER 7
CONTROL OVER PERSON AND PROPERTY OF DEBTOR

560.   Duties of the debtor as to discovery and realisation of property

  1.  

    (1)   Every debtor against whom a receiving order is made, shall, unless prevented by sickness or other sufficient cause, attend the first meeting of his or her creditors, and shall submit to such examination and give such information as the meeting may require.

    (2)   He or she shall give such inventory of his or her property, such list of his or her creditors and debtors, and of the debts due to and from them respectively, submit to such examination in respect of his or her property or his or her creditors, attend such meetings of his or her creditors, wait at such times on the receiver, special manager or trustee, execute such powers of attorney, conveyances, deeds and instruments, and generally do all such acts and things in relation to his or her property and the distribution of the proceeds amongst his or her creditors, as may be reasonably required by the receiver, special manager, or trustee, or may be prescribed by rules of Court, or be directed by the Court by any special order or orders made in reference to any particular case, or made on the occasion of any special application by the receiver, special manager, trustee, or any creditor or person interested.

    (3)   He or she shall, if adjudged a bankrupt, aid to the utmost of his or her power, in the realization of his or her property and the distribution of the proceeds amongst his or her creditors.

    (4)   If the debtor willfully fail to perform the duties imposed on him or her by this article, or to deliver up possession of any part of his or her property which is divisible amongst his or her creditors, and which is for the time being in his or her possession or under his or her control, to the receiver or to the trustee, or to any person authorised by the Court to take possession of it, he or she shall, in addition to any other punishment to which he or she may be subject, be guilty of a contempt of Court, and may be punished accordingly.
