547.   Proceedings on creditor's petition

  1.  

    (1)   A creditor's petition must be verified by affidavit of the creditor or of some person having knowledge of the facts.

    (2)   At the hearing the Court shall require proof of (a) the debt, (b) service of the petition, and (c) the act or bankruptcy; and if satisfied may make a receiving order as prayed.

    (3)   If the Court is not satisfied of all or any of the matters aforesaid, or is of opinion that the debtor can pay his or her debts, or that for other sufficient reason such order ought not to be made, the Court may dismiss the petition, or make such order in the premises, as it shall think fit.

    (4)   A creditor's petition after presentment shall not be withdrawn without leave of the Court.
