546.   When creditor may petition

  1.  

    (1)   A creditor shall not present a petition against a debtor unless—

    1.  

      (a)      the debt amounts to $72;

    1.  

      (b)      the debt is a liquidated amount or claim;

    1.  

      (c)     the act of bankruptcy averred in support has occurred within 3 months before presentation.

    (2)   If the creditor is a secured creditor, he or she must in his or her petition state that he or she is willing to give up his or her security for the benefit of the creditors in the event of adjudication, or estimate its value. In the latter case the balance of the debt must exceed $72.
