540.   Construction of accident policies

  1.  

    (1)   The construction of accident policies depends rather on the conditions contained than upon any general principles of law. But it is incumbent upon the plaintiff in any claim to prove, first, that an accident occurred within the meaning of the policy; and, secondly, that death or injury resulted from such accident.

    (2)   The expression “accident” denotes an unlooked-for mishap, or an untoward event which is neither expected nor designed, and involves either violence or casualty.

    (3)   Where an accident is proved to have occurred, the question whether it was or was not the decisive cause of the death or injury is a question of construction, to be determined according to the ordinary rules affecting remoteness of damage.
