251.   Duty of broker

It is the duty of a broker—

(1)   To contract in the name of his or her principal, subject to special instructions or usage to the contrary.

(2)   To execute contracts in such a way as to be legally binding on both parties, and so as to give each party a right to sue thereon.

(3)   To inform his or her principal of the actual terms of any contract made on his or her behalf.

(4)   To comply with statutory provisions and restrictions in making contracts, notwithstanding trade usage to the contrary.

(5)   Carefully to estimate the value of the goods entrusted to him or her for sale and communicate his or her opinion to his or her principal.

(6)   Not to deliver goods sold by him or her, except in accordance with the terms of sale.

(7)   Not to sell his or her own property to his or her principal, or buy his or her principal's property himself, without full disclosure.
