249.   Implied authority of factors

  1.  

    A factor has implied authority—

(1)   To sell goods entrusted to him or her for sale in his or her own name, at such times, and for such prices as he or she thinks fit.

(2)   To sell on reasonable credit.

(3)   To warrant the goods sold, if such has been his or her habit or is customary.

(4)   To receive payment of the price, if he or she sells in his or her own name.
