248.   Duties of factors

  1.  

    It is the duty of a factor—

(1)   To give his or her principal the free and unbiased use of his or her judgment and discretion.

(2)   To act in person, unless authorised to delegate his or her authority.

(3)   To keep and render just and true accounts.

(4)   To keep the property of his or her principal separate from his or her own and from that of other persons.

(5)   To keep each sale distinct and separate from other transactions.

(6)   To account for goods sold, pay over the pro. . . unsold goods to the principal, on den. . .

(7)   Not to barter or pledge goods entrusted to him or her for sale unless expressly authorised thereto.

(8)   To insure goods consigned to him or her, if such has been his or her habit or is customary.

(9)   Not to purchase his or her principal's goods for himself or herself without full disclosure.
