19.   Offences

  1.  

    (1)   Any person who obstructs the Chief Fire Officer or an inspector in the execution of his or her powers or duties under this Act is liable on summary conviction to a fine of $100 or to imprisonment for a term of 2 months.

    (2)   Subject to the provisions of this Act an owner who uses or permits an industrial or commercial building to be used in contravention of section 5 is liable on summary conviction to a fine of $500 or to imprisonment for a term of 6 months and if the contravention is continued after conviction, he or she subject to section 20 commits a further offence and is liable on summary conviction to a fine not exceeding $50 for each day in which the contravention is so continued.

    (3)   A person who—

    1.  

      (a)     forges or counterfeits a certificate required under this Act;

    1.  

      (b)     gives or signs such certificate knowing it to be false in any material particular;

    1.  

      (c)     knowingly utters or makes use of such certificates so forged, counterfeited or falsified as aforesaid;

    1.  

      (d)     falsely pretends to be an inspector;

    1.  

      (e)     wilfully connives at any such forging, counterfeiting, giving or signing, altering, making use or pretending as aforesaid;

      (f)     wilfully makes a false entry in a notice, the certificate of the register required by order or for the purposes of this Act;

    1.  

      (g)     wilfully makes or signs a false declaration required by or under or for the purposes of this Act,

    is liable on summary conviction to a fine of $500 or to imprisonment for a term of 6 months.

    (4)   Subject to the provisions of this Act or under the regulations made under it an owner who fails to perform or cause any duty to be performed as provided by this Act or by the regulations in relation to or in connection with in industrial or commercial building is liable on summary conviction to a fine of $250 or to imprisonment for a term of 3 months and if the contravention in respect of which he or she was convicted is continued after the conviction he or she subject to the provisions of section 20 commits a further offence and is liable on summary conviction to a fine of $25 for each day on which the contravention is so continued; however, an owner shall not be convicted of an offence under this section where the act, omission or default resulting in the failure or neglect of duty was not caused by his or her act omission or default.

    (5)   An owner or occupier who neglects or refuses to remove any article in respect of which a notice has been served on him or her under section 16 is liable on summary conviction to a fine of $100 or to imprisonment of a term of one month and if the contravention in respect of which he or she was convicted is continued after the conviction he or she subject to the provisions of section 20 commits a further offence and is liable on summary conviction to a fine of $10 for each day on which the contravention is so continued.
