13.   Proceedings in lieu of notice with respect dangerous escape

    (1)   If it appears to an inspector that the conditions in regard to escape in case of fire in any industrial or commercial building are so dangerous for that building or any part of it ought not to be used or ought not to be used for a particular process, work or purpose, until steps have been taken to remedy the danger, he or she may, in lieu of serving a notice on the Chief Fire Officer under section 12(1) make a complaint to a court of summary jurisdiction, and the court may, if satisfied of the matters aforesaid, by order prohibit the use of that building or part thereof, or its use for the particular process, work or purpose, until such works have been executed as are in the opinion of the court necessary to remedy the danger.

    (2)   Where any works have been executed under an order under subsection (1), the inspector shall give notice thereof to the Chief Fire Officer, who shall amend any certificate in force under section 9 in respect of that building, or issue other certificate, as the case may require.
